The establishment of a deed of marriage follows a rigorous formalism supervised by the family court.
The processing time varies depending on document availability. It involves gathering all required documents (medical certificate, etc.) in accordance with Article 65. Important note: for documents belonging to Moroccans residing abroad (MREs), apostille formalities must be completed in advance to avoid any delays.
The visa is generally issued within an indicative timeframe of 2 to 5 days. The judge presiding over the marriage reviews the file and affixes the visa required by Article 65. This step is mandatory before the marriage certificate can be drawn up.
Once the visa is obtained, authorization is generally immediate. The judge authorizes the notaries to execute the deed, in accordance with Article 65, and the file is assigned a sequential number. This formality initiates the finalization phase of the deed.
The conclusion is made immediately: the consents are exchanged before two adoul, with signature of the spouses and mention of the Sadaq, according to article 67. Then, the homologation takes place within a maximum period of 15 days: transcription and affixing of the judge's seal in accordance with article 68, and the original is given to the wife.
