application de la Loi 71-24, qui modifie la loi 15-95 formant le Code de commerce marocain. Ce nouveau cadre pr\u00e9cise avec rigueur les obligations du tireur, les droits du b\u00e9n\u00e9ficiaire ainsi que les pr\u00e9rogatives de l\u2019\u00e9tablissement bancaire.\n\nFort de 13 ann\u00e9es d\u2019expertise au Barreau de Safi, le <a href=\"https:\/\/avocatmarocain.com\/contact\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3597\">Cabinet de Ma\u00eetre Amal Anouide<\/a> analyse, pour les citoyens comme pour les entreprises, les nouvelles exigences juridiques et p\u00e9nales applicables au Paiement par ch\u00e8que Maroc.\n<h2>Impact de la Nouvelle loi sur les ch\u00e8ques impay\u00e9s maroc<\/h2>\nL\u2019Article 316 du Code de commerce qualifie l\u2019omission de maintenir ou de constituer la provision d\u2019un ch\u00e8que de d\u00e9lit passible d\u2019un \u00e0 cinq ans d\u2019emprisonnement et d\u2019une amende. La Nouvelle loi sur les ch\u00e8ques impay\u00e9s maroc, introduite par la Loi 71-24, apporte toutefois des m\u00e9canismes <a href=\"https:\/\/avocatmarocain.com\/peines-alternatives\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3598\">nouveaux permettant \u00e0 la justice<\/a> d\u2019accorder un d\u00e9lai pour constituer la provision, ce qui modifie le d\u00e9roulement de la poursuite.\n\nLe l\u00e9gislateur marocain a \u00e9galement instaur\u00e9 des mesures pr\u00e9ventives avant le d\u00e9clenchement de l\u2019action publique. Ainsi, l\u2019Article 325 du Code de commerce, tel que modifi\u00e9 par la Loi 71-24, impose \u00e0 la police judiciaire, sur instruction du Minist\u00e8re public, d\u2019adresser une mise en demeure au tireur.\n\n\u00c0 compter de cette mise en demeure, le tireur dispose d\u2019un d\u00e9lai de 30 jours pour r\u00e9gulariser sa situation financi\u00e8re. Le Minist\u00e8re public peut assortir cette mesure de <a href=\"https:\/\/avocatmarocain.com\/mariage-par-procuration-au-maroc\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3599\">contr\u00f4les judiciaires<\/a>, notamment le port du bracelet \u00e9lectronique. Lorsque le Paiement par ch\u00e8que Maroc sans provision concerne le conjoint, les ascendants ou les descendants au premier degr\u00e9 du tireur, l\u2019action publique est annul\u00e9e. Cette exemption s\u2019\u00e9tend jusqu\u2019\u00e0 quatre ann\u00e9es apr\u00e8s la <a href=\"https:\/\/avocatmarocain.com\/dissolution-du-mariage\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3586\">dissolution du mariage<\/a>. Le d\u00e9lai de 30 jours peut par ailleurs \u00eatre prolong\u00e9 par le Minist\u00e8re public, sous r\u00e9serve de l\u2019accord explicite du b\u00e9n\u00e9ficiaire du ch\u00e8que.\n<h2>Les diff\u00e9rents types et r\u00e8gles de pr\u00e9sentation<\/h2>\nL\u2019Article 239 du Code de commerce \u00e9num\u00e8re les mentions indispensables \u00e0 la validit\u00e9 du titre de paiement : le mandat pur et simple de payer une somme d\u00e9termin\u00e9e, le nom du tir\u00e9, la signature du tireur, ainsi que les autres indications exig\u00e9es par la loi. L\u2019Article 268 du Code de commerce fixe ce d\u00e9lai \u00e0 vingt jours calendaires pour les ch\u00e8ques \u00e9mis et payables sur le territoire marocain. Il est port\u00e9 \u00e0 soixante jours pour les ch\u00e8ques \u00e9mis \u00e0 l\u2019\u00e9tranger mais payables au Maroc. Le point de d\u00e9part du calcul correspond \u00e0 la date d\u2019\u00e9mission inscrite sur le titre.\n<h2>P\u00e9nalit\u00e9s et sanctions financi\u00e8res<\/h2>\nL\u2019Article 314 du Code de commerce fixe les sanctions fiscales applicables au tireur ayant \u00e9mis un ch\u00e8que rejet\u00e9 pour d\u00e9faut ou insuffisance de provision. Le paiement de la P\u00e9nalit\u00e9 ch\u00e8que impay\u00e9 Maroc 2026 constitue une condition essentielle pour obtenir la lev\u00e9e de l\u2019interdiction d\u2019\u00e9mettre des ch\u00e8ques.\n\nLe l\u00e9gislateur pr\u00e9voit une gradation des amendes fiscales afin de sanctionner la r\u00e9cidive en mati\u00e8re de Paiement par ch\u00e8que Maroc :\n<ul>\n \t<li><strong>Tableau d&rsquo;\u00e9volution de la P\u00e9nalit\u00e9 ch\u00e8que impay\u00e9 Maroc 2026<\/strong><\/li>\n<\/ul>\n<table>\n<tbody>\n<tr>\n<td><strong>Statut de l&rsquo;injonction bancaire<\/strong><\/td>\n<td><strong>Taux de la p\u00e9nalit\u00e9 fiscale applicable<\/strong><\/td>\n<\/tr>\n<tr>\n<td>Premi\u00e8re injonction<\/td>\n<td>0,5 % du montant du ch\u00e8que impay\u00e9 (ou du manque de provision).<\/td>\n<\/tr>\n<tr>\n<td>Deuxi\u00e8me injonction<\/td>\n<td>1 % du montant du ch\u00e8que impay\u00e9.<\/td>\n<\/tr>\n<tr>\n<td>Troisi\u00e8me injonction et injonctions subs\u00e9quentes<\/td>\n<td>1,5 % du montant du ch\u00e8que impay\u00e9.<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\nNote l\u00e9gale : Le Code de commerce fixe le plancher de cette amende fiscale \u00e0 500 dirhams et son plafond \u00e0 50.000 dirhams. Le tireur en est exempt\u00e9 s\u2019il r\u00e8gle la provision dans un d\u00e9lai de trois mois suivant le premier avertissement bancaire.\n<h2>Proc\u00e9dure l\u00e9gale de R\u00e9gularisation ch\u00e8que impay\u00e9 maroc<\/h2>\nL\u2019Article 313 du Code de commerce oblige l\u2019\u00e9tablissement bancaire tir\u00e9 \u00e0 adresser une injonction au titulaire du compte. Cette injonction lui interdit d\u2019\u00e9mettre de nouveaux ch\u00e8ques pendant une dur\u00e9e de dix ans et exige la restitution de toutes les formules de ch\u00e8ques encore en sa possession. Sur le plan p\u00e9nal, le l\u00e9gislateur interdit express\u00e9ment l\u2019acceptation d\u2019un ch\u00e8que \u00e0 titre de garantie.\n\nIssue : Depuis l\u2019entr\u00e9e en vigueur de la Loi 71-24, le fournisseur qui accepte un ch\u00e8que en garantie encourt une amende p\u00e9nale de 2 % calcul\u00e9e sur la valeur faciale du titre. Quant au tireur ayant effectu\u00e9 ce Paiement par ch\u00e8que Maroc, son compte peut \u00eatre d\u00e9bit\u00e9 imm\u00e9diatement si le cr\u00e9ancier pr\u00e9sente le ch\u00e8que \u00e0 l\u2019encaissement.
