<strong>Artikelen 78 tot en met 128 van de Moudawana<\/strong> (Wet nr. 70-03) regelt de ontbinding van een huwelijk onder gerechtelijk toezicht.<\/li><li><strong>gerechtelijk toezicht<\/strong> Een echtscheidingsverzoek moet door de rechtbank worden goedgekeurd en door beide partijen worden ondertekend. <strong>Adoul<\/strong>.<\/li><li><strong>Wettelijke termijn voor het indienen van een geschil<\/strong> De scheidingsprocedure bij onenigheid (<em>Zeker<\/em>) is beperkt tot een maximale periode van <strong>zes maanden<\/strong>.<\/li><li><strong>Vereiste documenten<\/strong> De aanvrager moet het origineel van het document overleggen.<strong>huwelijksakte<\/strong> en een identiteitsbewijs.<\/li><li><strong>Specificiteit van MRE<\/strong> Juridische bijstand zonder te hoeven echtscheidingswet in Marokko<\/strong> In 2026 werd het rechterlijk toezicht versterkt om eerlijkheid tussen echtgenoten en de bescherming van kinderen te waarborgen. Inzicht in de verschillende vormen van echtscheiding en de bijbehorende procedurele termijnen is essentieel voor het veiligstellen van financi\u00eble en familierechten. Dit artikel analyseert de huidige hervormingen, onderhoudsverplichtingen en specifieke procedures voor Marokkanen die in het buitenland wonen.<\/p><h2>Rechterlijk toezicht en de nieuwe echtscheidingswet in Marokko<\/h2><p>L'<strong>Artikel 78 van de Moudawana<\/strong> bepaalt dat de <a href=\"https:\/\/avocatmarocain.com\/faq-droit-de-la-famille-au-maroc\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3006\">Scheiding is de ontbinding van het huwelijkscontract.<\/a> Uitgevoerd onder toezicht van het rechtssysteem. De Marokkaanse wet vereist dat iedereen die wil scheiden, toestemming moet vragen aan de rechtbank van de echtelijke woonplaats of de woonplaats van de vrouw.<\/p><p>De <strong>Nieuwe echtscheidingswet in Marokko<\/strong> bepaalt dat een scheiding alleen rechtsgeldig kan zijn als deze door beide partijen formeel wordt bevestigd. <strong>Adoul<\/strong> Ontbinding van het huwelijk is alleen toegestaan \u200b\u200bna rechterlijke toestemming. Elke scheiding buiten dit kader is strafbaar en heeft geen rechtsgevolgen voor de burgerlijke staat van de echtgenoten.<\/p><h2>Scheidingsprocedures wegens onenigheid (Chiqaq) en termijnen 2026<\/h2><p>L'<strong>Artikel 94 van de Moudawana<\/strong> regelt echtscheiding wegens onenigheid (<em>Zeker<\/em>Deze procedure wordt gestart wanneer een diepgaand meningsverschil het samenleven onmogelijk maakt. Het is de meest gevraagde procedure omdat beide echtgenoten hiermee een wettelijke scheiding kunnen aanvragen.<\/p><p>De familierechtbank moet proberen een <strong>verzoening<\/strong> tussen de echtgenoten in de rechterlijke kamers. Als de bemiddelingspogingen mislukken, spreekt de rechter de uitspraak uit. <a href=\"https:\/\/avocatmarocain.com\/avocat-en-droit-administratif-marrakech\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3007\">scheiding en uitspraak over rechten<\/a> financi\u00eble binnen een periode van maximaal <strong>zes maanden<\/strong>.<\/p><h2>Scheiding met wederzijds goedvinden en de voorwaarden daarvoor.<\/h2><p>L'<strong>Artikel 114 van de Moudawana<\/strong> Het stelt echtgenoten in staat om overeenstemming te bereiken over de scheiding, al dan niet onder voorwaarden. Bij dit type scheiding, ook wel bekend als een scheiding met wederzijds goedvinden, moet een schriftelijke overeenkomst aan de rechtbank worden voorgelegd.<\/p><p>De rechtbank probeert de partijen te verzoenen alvorens de machtiging te verlenen. <strong>Adoul<\/strong> Het opstellen van het echtscheidingsvonnis. Als de echtgenoten het eens zijn over het principe, maar het niet eens zijn over het bedrag, grijpt de rechter in om het bedrag vast te stellen.<\/p><p>De rechter bepaalt de hoogte van de schadevergoeding rekening houdend met de duur van het huwelijk en de hoogte van de bruidsschat.<em>Goed doel<\/em>) en de redenen voor de scheiding. Als de echtgenote minderjarig is, is de toestemming van haar wettelijke vertegenwoordiger vereist om de financi\u00eble compensatie te kunnen vaststellen.<\/p><h2>Financi\u00eble gevolgen en alimentatie (Nafaqa)<\/h2><p>L'<strong>Artikel 84 van de <\/strong><a href=\"https:\/\/avocatmarocain.com\/procedure-de-divorce-au-maroc\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3005\">Moudawana verduidelijkt de rechten<\/a> aan de echtgenote verschuldigd, inclusief het resterende deel van de bruidsschat, het weduwenpensioen (<em>Zij<\/em>) en de gave van troost (<em>Mond<\/em>). De <strong>Nieuwe echtscheidingswet in Marokko<\/strong> dringt aan op de evaluatie van de <em>Mond<\/em> afhankelijk van de financi\u00eble situatie van de echtgenoot.<\/p><p>De verplichting om <strong>Alimentatie<\/strong> (<em>toelage<\/em>) dekt voedsel, kleding, medische zorg en huisvesting.
