rechtsvormen en belangrijke hervormingen uiteengezet die zijn ingevoerd door Wet nr. 71.24 tot wijziging van het Wetboek van Koophandel, en die essentieel zijn voor de veiligheid van transacties:<\/p>\n<ul>\n<li><strong>Limiet voor contante betalingen:<\/strong> Verplichting om voor alle commerci\u00eble betalingen van meer dan 10.000 dirhams gebruik te maken van een gekruiste cheque of een bankoverschrijving.<\/li>\n<li><strong>Centralisatie en digitalisering:<\/strong> Bank Al-Maghrib beheert een digitaal platform dat het elektronisch bevriezen van tegoeden en de onmiddellijke verificatie van de verstrekking mogelijk maakt.<\/li>\n<li><strong>Uiterste inleverdatum voor recepten:<\/strong> Het verhaalrecht van de houder op de trekker is onderworpen aan een verjaringstermijn van zes maanden, te rekenen vanaf het einde van de presentatieperiode.<\/li>\n<li><strong>Sanctieregime:<\/strong> Het uitschrijven van een cheque zonder voldoende dekking is strafbaar met een gevangenisstraf van zes maanden tot drie jaar, behalve in specifieke gevallen van opname of nauwe familiebanden.<\/li>\n<li><strong>Bescherming van niet-ingezetenen:<\/strong> <a Marokko: Financi\u00eble veiligheid en hervormingen van de handelsjustitie<\/h1>\n<p>Het juridische landschap van <strong>check in Marokko<\/strong> ondergaat een ingrijpende transformatie onder invloed van Wet nr. 71.24, die tot doel heeft het vertrouwen in dit betaalmiddel, dat essentieel is voor de nationale economie, te herstellen.<\/p>\n<h2>Definitie en geldigheid van het betaalmiddel<\/h2>\n<p>De <strong>rekening <a href=\"https:\/\/avocatmarocain.com\/\" target=\"_blank\" rel=\"noopener\" data-wpil-monitor-id=\"2783\">Marokko<\/a><\/strong> is een betaalmiddel dat valt onder artikel 240 van de <a href=\"https:\/\/rnesm.justice.gov.ma\/Documentation\/MA\/3_TradeRecord_fr-FR.pdf\" target=\"_blank\" rel=\"noopener\">Handelswetboek<\/a>Een cheque moet bepaalde verplichte informatie bevatten voor zijn rechtsgeldigheid. Een geldige cheque moet de onvoorwaardelijke opdracht tot betaling van een specifiek bedrag, de naam van de bank (de betrokkene), de plaats van betaling, de datum, de plaats van uitgifte en de handtekening van de trekker bevatten.<\/p>\n<p>De afwezigheid van een van deze <a href=\"https:\/\/avocatmarocain.com\/contrat-de-mariage-au-maroc\/\" target=\"_blank\" rel=\"noopener\" data-wpil-monitor-id=\"2795\">priv\u00e9 vermeldt het document<\/a> vanwege de classificatie als cheque, hoewel het opnieuw geclassificeerd kan worden als een eenvoudig document dat een schuld tussen de partijen bewijst. Om de transparantie te versterken, vereist artikel 306 dat elke betaling tussen handelaren die een bedrag overschrijdt van <strong>10.000 dirhams<\/strong> hetzij door middel van een gekruiste cheque, waardoor de circulatie van ontraceerbaar contant geld wordt beperkt.<\/p>\n<h2>Beheer van betalingsincidenten en bankmelding<\/h2>\n<p>Het betalingsincident vindt plaats wanneer de begunstigde <a href=\"https:\/\/avocatmarocain.com\/nouvelle-loi-sur-le-divorce-au-maroc\/\" target=\"_blank\" rel=\"noopener\" data-wpil-monitor-id=\"2796\">presenteert een <strong>check in Marokko<\/strong><\/a> en dat de <strong>voorafgaande bepaling<\/strong>De liquide middelen zijn ontoereikend. Artikel 313 bepaalt dat de bankinstelling in geval van ontoereikende middelen verplicht is een bewijs van niet-betaling af te geven en de trekker hiervan formeel in kennis te stellen.<\/p>\n<p>Het proces wordt geautomatiseerd door het aanmaken van een <strong>Centraal meldpunt voor betalingsincidenten<\/strong> Beheerd door Bank Al-Maghrib. Dit platform stelt banken nu in staat om betalingsachterstanden in realtime te melden, wat leidt tot een onmiddellijk bankverbod voor de trekker, die gedurende vijf jaar geen cheques meer mag uitschrijven, tenzij de situatie is rechtgezet.<\/p>\n<p><strong>Tabel 1: Termijnen voor verjaring en beroep (Artikel 295)<\/strong><\/p>\n<p>Het kabinet benadrukt het belang van het naleven van deadlines. <a href=\"https:\/\/avocatmarocain.com\/avocat-en-droit-administratif-marrakech\/\" target=\"_blank\" rel=\"noopener\" data-wpil-monitor-id=\"2785\">wettelijke rechten om rechten te beschermen<\/a> schuldeisers. Artikel 314 definieert een progressieve schaal van belastingboetes, bedoeld om nalatigheid of fraude te bestraffen, terwijl het tegelijkertijd de mogelijkheid biedt tot terugkeer naar de normale situatie.<\/p>\n<p>De belastingboete wordt berekend over de nominale waarde van de onbetaalde cheque. De schutter riskeert een gevangenisstraf van zes maanden tot drie jaar en een boete van 5.000 tot 20.000 dirham.<\/p>\n<p>Het nieuwe beleid <a href=\"https:\/\/avocatmarocain.com\/peines-alternatives\/\" target=\"_blank\" rel=\"noopener\" data-wpil-monitor-id=\"2793\">Marokkaanse strafrechtspraak<\/a> Het introduceert een vorm van gedeeltelijke decriminalisering om minnelijke schikkingen aan te moedigen. Volgens artikel 316 kan de vervolging worden geseponeerd als de trekker de begunstigde compenseert voordat er een vonnis is uitgesproken.
