Maroc : Conditions, Contenu et Proc\u00e9dure de Contr\u00f4le Judiciaire<\/h1><p>Le <strong>mariage par procuration au maroc<\/strong> est une modalit\u00e9 exceptionnelle de conclusion de l&rsquo;acte de mariage permettant \u00e0 l&rsquo;un des futurs \u00e9poux de se faire repr\u00e9senter. Bien que l&rsquo;<strong>article 4<\/strong> de la Moudawana d\u00e9finisse le mariage comme un pacte fond\u00e9 sur le consentement mutuel en vue d&rsquo;\u00e9tablir une union durable sous la direction des deux \u00e9poux, le l\u00e9gislateur a pr\u00e9vu des m\u00e9canismes de flexibilit\u00e9 pour r\u00e9pondre \u00e0 des situations d&#8217;emp\u00eachement majeures.<\/p><h2>D\u00e9finition Juridique du Mandat Matrimonial<\/h2><p>Le mandat de mariage est l&rsquo;acte juridique par lequel une personne (le mandant) d\u00e9l\u00e8gue \u00e0 une autre (le mandataire) le pouvoir de conclure en son nom un acte de mariage. Selon l&rsquo;<strong>article 17<\/strong> du Code de la Famille, cette proc\u00e9dure n&rsquo;est possible que sur autorisation du juge et sous r\u00e9serve du respect strict de conditions de fond et de forme. Son r\u00f4le ne se limite pas \u00e0 une simple v\u00e9rification administrative ; il doit s&rsquo;assurer que le consentement n&rsquo;est pas vici\u00e9 par la contrainte ou le dol.<\/p><p>L&rsquo;<strong>article 17 (alin\u00e9a 6)<\/strong> dispose que le juge doit viser le mandat apr\u00e8s s&rsquo;\u00eatre assur\u00e9 de sa conformit\u00e9 totale aux conditions requises par la loi. Ce contr\u00f4le judiciaire est fondamental car l&rsquo;<strong>acte de mariage<\/strong> ne pourra \u00eatre dress\u00e9 par les <strong>adoul<\/strong> qu&rsquo;apr\u00e8s cette homologation pr\u00e9alable.
