Marokko<\/a>, gecodificeerd door Wet nr. 70-03 betreffende het Familiewetboek, definieert echtscheiding als een ontbinding van de huwelijksbanden, uitgeoefend door de echtgenoot of de echtgenote, onder strikt toezicht van de justitie. Deze moderne wetgeving heeft tot doel het beroep op de verbreking van het huwelijkspact te beperken door systematische verzoeningsprocedures op te leggen en rechtvaardigheid voor elke partij te waarborgen.<\/p><h2>Typologie van de ontbinding van het huwelijkspact<\/h2><p>De <a href=\"https:\/\/avocatmarocain.com\/dissolution-du-mariage\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"2894\">ontbinding van het huwelijk<\/a> In Marokko vindt een echtscheiding plaats na het overlijden van een van de echtgenoten, de ontbinding van het huwelijkscontract, een echtscheiding onder gerechtelijk toezicht of een gerechtelijke echtscheiding (Tatliq). Het Familierecht benadrukt het uitzonderlijke karakter van deze vorm van scheiding en stelt de stabiliteit van het gezin en de bescherming van kinderen tegen de schade die een gezinsbreuk kan veroorzaken voorop.<\/p><h3>Echtscheiding met onderlinge toestemming<\/h3><p>Echtscheiding met onderlinge toestemming is een overeenkomst tussen beide echtgenoten om hun verbintenis te be\u00ebindigen, met of zonder voorwaarden, mits deze de belangen van de kinderen niet schaden. Bij overeenstemming wordt het verzoek ingediend bij de rechtbank die, na een mislukte verzoeningspoging, toestemming geeft voor het opstellen van de akte door twee adouls.<\/p><h3>Echtscheiding op grond van onenigheid (Chiqaq)<\/h3><p>De procedure wegens onenigheid (Chiqaq) wordt gestart wanneer een van de echtgenoten, of beiden, de rechtbank verzoeken om een diepgaand geschil op te lossen dat tot een definitieve breuk dreigt te leiden. De rechtbank wijst twee arbiters of de familieraad aan voor een bemiddelingspoging; als dit mislukt, wordt de echtscheiding binnen maximaal zes maanden uitgesproken, waarbij de rechter beslist over de verschuldigde financi\u00eble rechten.<\/p><h3>Gerechtelijke echtscheiding op grond van schade (Tatliq)<\/h3><p>Gerechtelijke echtscheiding kan eenzijdig door de echtgenote worden verzocht om specifieke redenen, zoals het niet naleven van de voorwaarden van de huwelijksakte, geweld, gebrek aan onderhoud, langdurige afwezigheid van de echtgenoot of een verborgen gebrek. Tijdens haar wachtperiode, die doorgaans drie menstruatiecycli of drie maanden duurt, moet zij in de echtelijke woning kunnen verblijven of een passende huisvestingsvergoeding ontvangen.<\/p><h3>Kinderalimentatie (Nafaqa)<\/h3><p>De vader is verplicht te voorzien in het onderhoud van zijn kinderen tot hun meerderjarigheid, of tot de leeftijd van 25 jaar als zij hoger onderwijs volgen. Huwelijksakten die in het buitenland zijn gesloten volgens de lokale formaliteiten, moeten binnen drie maanden worden ingediend bij de Marokkaanse consulaire diensten.<\/p><h3>Beheer van goederen en vertegenwoordiging op afstand<\/h3><p>De advocaat kan Marokkanen die in het buitenland wonen vertegenwoordigen zonder dat zij hoeven te reizen, met name voor het beheer van hun vastgoed of voor erfenisprocedures in Marokko. Consulten kunnen plaatsvinden via WhatsApp of videoconferentie, wat de toegang tot het Marokkaanse rechtssysteem vanuit het buitenland vergemakkelijkt.<\/p><h2>Het hoederecht (Hadana): Hoger belang en verblijfplaats<\/h2><p>Het hoederecht bestaat uit het beschermen van het kind tegen enig nadeel, het verzekeren van zijn opvoeding en het waken over zijn fysieke en morele gezondheid.<\/p><h3>Volgorde van prioriteit voor het hoederecht<\/h3><p>Het hoederecht wordt in de eerste plaats toevertrouwd aan de moeder, daarna aan de vader en vervolgens aan de grootmoeder van moederszijde. Op 15-jarige leeftijd heeft het kind de vrijheid om te kiezen welke van beide ouders het hoederecht zal uitoefenen.<\/p><h3>Voorwaarden voor ontzetting en bezoekrecht<\/h3><p>Het huwelijk van de moeder die het hoederecht heeft, leidt niet automatisch tot het verlies van haar recht als het kind jonger is dan zeven jaar of lijdt aan een handicap die de zorg door anderen bemoeilijkt. De ouder die niet het hoederecht heeft, behoudt een recht op bezoek en verblijf, waarvan de modaliteiten bij overeenkomst of rechterlijke beslissing worden vastgesteld.<\/p><p><img loading=\"lazy\"
