Wat begon als een eeuwige belofte, bezegeld door de heilige daad van het huwelijk, is veranderd in een emotioneel en administratief doolhof. Of u nu inwoner bent van Casablanca, een Marokkaan die in Parijs of Montreal woont, of een buitenlander die in hart en nieren aan Marokko verbonden is, de ontbinding van het huwelijk is een ingrijpende gebeurtenis. Maar hier is de aardbeving wettelijk vastgelegd. Het gaat niet simpelweg om \"scheiden\", maar om het navigeren door een complex wetgevend meesterwerk: de Moudawana.<\/p><p>Sinds de historische hervorming van 2004 heeft Marokko een ware stille revolutie doorgemaakt. De tijd dat echtscheiding een willekeurige en eenzijdige bevoegdheid was, is voorbij. <strong>Nieuwe echtscheidingswet in Marokko<\/strong> Het introduceerde een filosofie van evenwicht, van het kiezen van het 'minste kwaad' en van strikte rechterlijke controle. Maar tussen de droge juridische teksten en de realiteit van uw zaak gaat een wereld van verschil.<\/p><p>Als experts in juridische strategie lezen we de wet niet alleen; we ontcijferen haar. Dit artikel is uw kompas. Het hertrouwen van de moeder leidt niet automatisch tot het verlies van het ouderlijk gezag (uitzonderingen art. 175).<\/li><li><strong>Kinderhuisvesting<\/strong> Dit is een aparte verplichting, los van de kinderalimentatie. De vader moet huisvesting bieden of de door de rechter vastgestelde huur betalen.<\/li><li><strong>MRE &amp; Uitvoering<\/strong> : Les divorces \u00e9trangers doivent \u00eatre <a href=\"https:\/\/avocatmarocain.com\/le-mariage-en-droit-marocain\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3089\">valid\u00e9s par un tribunal marocain<\/a> (Art. 128) pour avoir force de loi au Maroc.<\/li><\/ol><\/li><\/ul><h2>I. De filosofie van hervorming: het einde van willekeur<\/h2><p>Om uw rechten vandaag de dag te begrijpen, moet u de geest van de wet die ze regelt, doorgronden. Het Familierecht (Wet nr. 70-03) is niet zomaar een opsomming van verboden. Zoals de preambule van de tekst benadrukt, heeft deze hervorming tot doel om <em>\"Om de menselijke waardigheid te behouden, zonder de tolerante principes van rechtvaardigheid, gelijkheid en solidariteit die de islam voorstaat, te verloochenen.\"<\/em>.<\/p><p>De wetgever heeft in artikel 70 een fundamenteel beginsel vastgelegd: <strong>Scheiding is een uitzondering.<\/strong>De ontbinding van het huwelijkscontract mag alleen als laatste redmiddel plaatsvinden, met inachtneming van de regel van <em>\"het minste kwaad\"<\/em>omdat het onvermijdelijk leidt tot het uiteenvallen van het gezin.<\/p><p>Daarom <strong>Nieuwe echtscheidingswet in Marokko<\/strong> De ontbinding van een echtscheiding valt onder de exclusieve bevoegdheid van de rechterlijke macht. Of u nu in goed overleg wilt scheiden of openlijk met elkaar in conflict bent, u kunt de rechter niet omzeilen. De wegen naar scheiding: welke procedure te kiezen?<\/h2><p>Het Marokkaanse rechtssysteem biedt een scala aan procedures die zijn afgestemd op de uiteenlopende aard van huwelijksproblemen. Het kiezen van de juiste procedure is de eerste strategische beslissing die u neemt en zal de duur, de kosten en de moeilijkheidsgraad van uw scheiding bepalen.<\/p><h3>1. Scheiding vanwege onenigheid (<em>Chiqaq<\/em>De pragmatische revolutie<\/h3><p>Dit is ongetwijfeld de belangrijkste en meest populaire vernieuwing van de hervorming. Gepland door de <strong>Artikelen 94 tot en met 97<\/strong>scheiding als gevolg van onenigheid (of <em>Chiqaq<\/em>) reageert op een simpele realiteit: soms is samenleven onmogelijk, zonder dat daarvoor een \"criminele\" fout hoeft te worden bewezen.<\/p><ul><li><strong>Het mechanisme:<\/strong> Wanneer een of beide echtgenoten de rechtbank verzoeken een geschil op te lossen dat dreigt tot onenigheid te leiden, verleent de rechtbank de echtscheiding niet onmiddellijk. De rechtbank heeft de verplichting om... <strong>poging tot verzoening<\/strong> (Artikel 94).<\/li><li><strong>Arbitrage:<\/strong> Als de bemiddeling mislukt, benoemt de rechtbank twee arbiters (vaak familieleden of deskundigen) om de oorzaken van het conflict te onderzoeken en een laatste poging te wagen het huwelijk te redden (artikel 95).<\/li><li><strong>De zin:<\/strong> Als verzoening onmogelijk blijkt, wijst de rechtbank de scheiding toe. Cruciaal is dat de rechter op dit punt de verantwoordelijkheid van elke partij vaststelt. Als de man schuldig is, betaalt hij meer. Als de vrouw schuldig is, kan haar alimentatie lager uitvallen.<\/li><li><strong>De deadline:<\/strong> Artikel 97 legt een ongekende snelheid op: een besluit over de actie moet binnen maximaal zes maanden worden genomen. Dit garandeert een <strong>Snelle scheidingsprocedure in Marokko<\/strong>Het vermijden van rechtszaken die jarenlang voortslepen.<\/li><\/ul><h3>2. Scheiding met wederzijds goedvinden: Het pad van wijsheid<\/h3><p>Als je nog steeds met je partner kunt communiceren, is dat de beste weg vooruit.<strong>artikel 114<\/strong> Het stelt de echtgenoten in staat om overeenstemming te bereiken over het principe van de scheiding en, vooral, over de voorwaarden ervan.<\/p><ul><li><strong>Contractvrijheid:<\/strong> U kunt zelf de hoogte van de kinderalimentatie, de voogdij en de verdeling van de bezittingen bepalen, zolang dit de belangen van de kinderen niet schaadt.<\/li><li><strong>Controle door de rechter:<\/strong> Ga er niet van uit dat een simpel ondertekend document voldoende is. Het verzoek wordt ingediend bij de rechtbank, die zal proberen te bemiddelen. Als dat niet lukt, controleert de rechter of de overeenkomst de openbare orde en de rechten van minderjarigen respecteert alvorens deze goed te keuren.<\/li><\/ul><h3>3. Scheiding met compensatie (<em>Khol'<\/em>)<\/h3><p>Dit is een specifieke procedure (artikelen 115-120) waarbij de vrouw haar vrijheid \"koopt\". De echtgenoten komen overeen te scheiden in ruil voor een vergoeding (vaak materieel of financieel) die door de vrouw wordt betaald.<\/p><ul><li>Als de echtgenote minderjarig is, kan zij deze vergoeding alleen betalen met toestemming van haar voogd (artikel 116).<\/li><li><em>Aandacht<\/em> : Si la m\u00e8re est insolvable, la compensation ne peut pas se faire au d\u00e9triment des droits des enfants (Article 119). On ne troque pas la pension alimentaire des enfants contre un divorce.<\/li><\/ul><h3>4. Le Divorce Judiciaire (<em>Tatliq<\/em>) pour Causes Sp\u00e9cifiques<\/h3><p>L\u2019article 98 ouvre la porte \u00e0 l\u2019\u00e9pouse pour demander le divorce judiciaire pour des causes pr\u00e9cises, prouvables et graves. C\u2019est une proc\u00e9dure plus \u00ab\u00a0technique\u00a0\u00bb qui demande un dossier solide.<\/p><ul><li><strong>Le D\u00e9faut d\u2019Entretien (Articles 102-103) :<\/strong> Si le mari refuse de subvenir aux besoins de l\u2019\u00e9pouse alors qu\u2019il en a les moyens, le tribunal peut prononcer le divorce imm\u00e9diatement. S\u2019il est indigent, un d\u00e9lai lui est accord\u00e9.<\/li><li><strong>L\u2019Absence (Articles 104-105) :<\/strong> Si l\u2019\u00e9poux dispara\u00eet plus d\u2019un an, l\u2019\u00e9pouse peut demander le divorce. Le tribunal v\u00e9rifiera cette absence par tous moyens.<\/li><li><strong>Le Vice R\u00e9dhibitoire (Articles 107-111) :<\/strong> Cela concerne des maladies graves ou des vices emp\u00eachant les rapports conjugaux (maladie mentale, impuissance, maladie contagieuse incurable). Les Droits Financiers : Le Nerf de la Guerre<\/h2><p>Abordons maintenant le sujet qui f\u00e2che, mais qui est essentiel pour votre avenir : l\u2019argent.
