Cette loi d\u00e9finit l\u2019ouverture de la succession, les h\u00e9ritiers, les quotes\u2011parts, les emp\u00eachements et les modalit\u00e9s de liquidation. En <a href=\"https:\/\/avocatmarocain.com\/divorce-marocain\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3761\">droit marocain<\/a>, la succession englobe l\u2019ensemble des biens et droits patrimoniaux du d\u00e9funt, apr\u00e8s d\u00e9duction prioritaire des charges, dettes et testaments valables, avant la r\u00e9partition entre les h\u00e9ritiers selon l\u2019ordre l\u00e9gal.<\/p>\n<p>Ce sujet occupe une place centrale du <a href=\"https:\/\/avocatmarocain.com\/avocat-en-droit-de-la-famille-au-maroc\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3759\">droit de la famille<\/a>, puisqu\u2019il touche \u00e0 la transmission du patrimoine, \u00e0 la protection des proches et \u00e0 l\u2019\u00e9quilibre entre exigences religieuses et s\u00e9curit\u00e9 juridique. Le Code de la <a href=\"https:\/\/avocatmarocain.com\/mouta\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3760\">Famille marocain<\/a> s\u2019appuie explicitement sur l\u2019Islam, le rite malikite et l\u2019effort d\u2019interpr\u00e9tation juridique (Ijtihad), tout en int\u00e9grant des proc\u00e9dures modernes applicables \u00e0 tous les Marocains, y compris les ressortissants \u00e9trangers, \u00e0 l\u2019exception des Juifs marocains soumis \u00e0 leur propre statut personnel. Cet article s\u2019inscrit dans le dossier global \u00ab\u202fDroit de la Famille au Maroc\u202f\u00bb, dont il constitue une pi\u00e8ce ma\u00eetresse pour appr\u00e9hender la transmission patrimoniale apr\u00e8s le d\u00e9c\u00e8s.<\/p>\n<h2><strong>\u00a0Principes fondamentaux du droit successoral marocain\u00a0 <\/strong><\/h2>\n<p>La Moudawana consacre un livre entier \u00e0 la succession et la d\u00e9finit ainsi\u202f: l\u2019h\u00e9ritage est la transmission <a href=\"https:\/\/avocatmarocain.com\/avocat-specialise-droit-de-la-famille-maroc\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3763\">d\u2019un droit<\/a> au d\u00e9c\u00e8s de son titulaire, apr\u00e8s liquidation de la succession, au profit de celui qui y pr\u00e9tend l\u00e9gitimement, sans contrepartie ni lib\u00e9ralit\u00e9. La succession comprend les biens et droits du d\u00e9funt, mais elle n\u2019est pas distribu\u00e9e imm\u00e9diatement\u202f: cinq cat\u00e9gories de charges doivent \u00eatre r\u00e9gl\u00e9es, dans un ordre imp\u00e9ratif.<\/p>\n<h3><strong>\u00a0Sources juridiques\u202f: la Moudawana et le rite malikite\u00a0 <\/strong><\/h3>\n<p>Le <a href=\"https:\/\/avocatmarocain.com\/motaa-au-maroc\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3758\">Code de la Famille constitue la source principale du droit<\/a> des successions. Son pr\u00e9ambule rappelle que le texte s\u2019appuie sur les finalit\u00e9s de l\u2019Islam, l\u2019uniformit\u00e9 du rite mal\u00e9kite et l\u2019Ijtihad, d\u2019o\u00f9 la pr\u00e9sence d\u2019institutions classiques telles que les\u202fFara\u2019id, le\u202fTa\u2019sib, le\u202fHajb et le legs obligatoire. La loi s\u2019applique \u00e0 tous les Marocains, m\u00eame ceux poss\u00e9dant une autre nationalit\u00e9, ainsi qu\u2019\u00e0 certaines situations mixtes pr\u00e9vues par l\u2019article\u202f2, ce qui rev\u00eat une importance particuli\u00e8re pour les successions internationales.<\/p>\n<h3><strong>\u00a0Conditions d\u2019ouverture d\u2019une succession\u00a0 <\/strong><\/h3>\n<p>La succession s\u2019ouvre par le d\u00e9c\u00e8s r\u00e9el ou pr\u00e9sum\u00e9 du d\u00e9funt, \u00e0 condition que l\u2019h\u00e9ritier soit vivant au moment du d\u00e9c\u00e8s. Le Code exige\u202f:\u00a0<\/p>\n<ol>\n<li>la certitude du d\u00e9c\u00e8s (r\u00e9el ou pr\u00e9sum\u00e9)\u202f;<\/li>\n<li>la survie de l\u2019h\u00e9ritier\u202f;<\/li>\n<li>la preuve du lien de parent\u00e9 conf\u00e9rant la qualit\u00e9 d\u2019h\u00e9ritier.<\/li>\n<\/ol>\n<p>Un jugement d\u00e9claratif est indispensable\u202f; tant qu\u2019il n\u2019est pas rendu, aucune succession ne peut \u00eatre ouverte ni partag\u00e9e. De m\u00eame, lorsqu\u2019une s\u00e9rie d\u2019h\u00e9ritiers meurt sans qu\u2019on puisse \u00e9tablir l\u2019ordre des d\u00e9c\u00e8s, aucun d\u2019eux ne peut h\u00e9riter de l\u2019autre.<\/p>\n<h3><strong>\u00a0Les trois piliers de l\u2019h\u00e9ritage\u00a0 <\/strong><\/h3>\n<p>Le raisonnement successoral repose sur\u202f: le d\u00e9funt, l\u2019h\u00e9ritier et la masse successorale. La Moudawana r\u00e9sume cela juridiquement\u202f: le d\u00e9c\u00e8s du titulaire du droit, l\u2019existence de l\u2019h\u00e9ritier et l\u2019ensemble des biens ou droits transmis apr\u00e8s liquidation. Avant tout partage, il faut proc\u00e9der \u00e0 la liquidation selon l\u2019ordre fix\u00e9 \u00e0 l\u2019article\u202f322\u202f:\u00a0<\/p>\n<ol>\n<li>charges grevant les biens r\u00e9els ;<\/li>\n<li>frais fun\u00e9raires, dans les limites de la convenance ;<\/li>\n<li>dettes du d\u00e9funt ;<\/li>\n<li>testament valable et ex\u00e9cutoire ;<\/li>\n<li>droits successoraux des h\u00e9ritiers.<\/li>\n<\/ol>\n<p>Cette hi\u00e9rarchie est cruciale. Beaucoup de familles pensent que les h\u00e9ritiers acqui\u00e8rent imm\u00e9diatement tous les biens, alors qu\u2019en r\u00e9alit\u00e9 le partage n\u2019intervient qu\u2019apr\u00e8s le r\u00e8glement du passif et l\u2019ex\u00e9cution \u00e9ventuelle du testament.<\/p>\n<h2><strong>\u00a0Cat\u00e9gories d\u2019h\u00e9ritiers et ordre de priorit\u00e9\u00a0 <\/strong><\/h2>\n<p>L\u2019article\u202f334 distingue quatre cat\u00e9gories\u202f: les h\u00e9ritiers \u00e0\u202fFardh\u202fseulement, les h\u00e9ritiers par\u202fTa\u2019sib\u202fseulement, ceux qui cumulent les deux qualit\u00e9s, et ceux qui peuvent relever de l\u2019une ou de l\u2019autre selon la configuration familiale.<\/p>\n<h3><strong>\u00a0H\u00e9ritiers r\u00e9servataires (Ashab al<\/strong><strong>\u2011Fara<\/strong><strong>\u2019id)\u00a0 <\/strong><\/h3>\n<p>Le\u202fFardh\u202fest une part successorale fix\u00e9e par la loi, attribu\u00e9e prioritairement \u00e0 certains h\u00e9ritiers. Les parts de\u202fFardh\u202fse composent de six fractions\u202f: \u00bd, \u00bc, \u215b, \u2154, \u2153 et \u2159.\u00a0<\/p>\n<p>Parmi les h\u00e9ritiers \u00e0\u202fFardh\u202fseulement, on trouve la m\u00e8re, l\u2019a\u00efeule, l\u2019\u00e9poux, l\u2019\u00e9pouse, le fr\u00e8re et la s\u0153ur ut\u00e9rins.
