Par ailleurs, l\u2019article 128 pr\u00e9cise que la partie du jugement mettant fin aux liens conjugaux n\u2019est susceptible d\u2019aucun recours, ce qui s\u00e9curise le statut civil des parties.<\/p><h3>Quels sont les motifs de divorce pour discorde au Maroc ?<\/h3><p>L\u2019un des principaux avantages du Chiqaq r\u00e9side dans sa souplesse concernant les motifs invoqu\u00e9s. L\u2019article 2 de la Moudawana est explicite : les dispositions du Code s\u2019appliquent \u00e0 tous les Marocains, m\u00eame lorsqu\u2019ils poss\u00e8dent une autre nationalit\u00e9.<\/p><p>Le chiqaq MRE r\u00e9pond toutefois \u00e0 des r\u00e8gles de comp\u00e9tence territoriale pr\u00e9cises. La requ\u00eate doit \u00eatre d\u00e9pos\u00e9e devant la section de la justice de la famille du tribunal de premi\u00e8re instance comp\u00e9tent.<\/p><p>Selon les r\u00e8gles de proc\u00e9dure civile, le tribunal comp\u00e9tent peut \u00eatre celui du domicile conjugal au Maroc, du domicile de l\u2019\u00e9pouse ou, \u00e0 d\u00e9faut, celui du lieu de conclusion de l\u2019acte de mariage.
