It is not limited to the simple residence of the child with one of the parents; it aims above all at the child's protection, education, moral and physical security, as well as the safeguarding of their long-term interests.\u00a0<\/p>\n<p>Dans les cas de s\u00e9paration ou de divorce, la question de la garde devient souvent le point le plus sensible du conflit familial, car elle touche \u00e0 l\u2019affectif, \u00e0 l\u2019autorit\u00e9 parentale, au logement, \u00e0 la pension alimentaire et au droit de visite. Le <a href=\"https:\/\/avocatmarocain.com\/motaa-au-maroc\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3334\">Family Code<\/a> encadre donc ce domaine avec pr\u00e9cision, en faisant de l\u2019int\u00e9r\u00eat sup\u00e9rieur de l\u2019enfant la r\u00e8gle d\u2019or, au\u2011del\u00e0 des rivalit\u00e9s entre adultes.\u00a0<\/p>\n<p>Cet article pr\u00e9sente\u202f: le cadre l\u00e9gal de la Hadana, l\u2019ordre de priorit\u00e9 entre les membres de la famille, les conditions requises pour exercer la garde, les effets du remariage de la m\u00e8re, les cas de retrait du droit de garde, les r\u00e8gles du <a href=\"https:\/\/avocatmarocain.com\/avocat-en-droit-administratif-marrakech\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3335\">droit de visite du p\u00e8re divorc\u00e9<\/a>, ainsi que le lien entre garde, logement et pension alimentaire.\u00a0<\/p>\n<h2><strong>\u00a0The legal framework of Hadana\u00a0 <\/strong><\/h2>\n<p>The Family Code defines Hadana as <strong>the obligation to protect the child from all harm, to educate him\/her and to safeguard his\/her interests<\/strong>The text specifies that the guardian must, as far as possible, take all necessary measures for the physical and moral safety of the child, particularly in the absence of the legal representative or when the child's interests are likely to be compromised.\u00a0<\/p>\n<p>Tant que le mariage subsiste, la garde incombe conjointement au p\u00e8re et \u00e0 la m\u00e8re. Si aucun des titulaires potentiels n\u2019accepte la garde, ou si celui qui l\u2019accepte ne remplit pas les conditions l\u00e9gales, les parties int\u00e9ress\u00e9es ou le minist\u00e8re <a href=\"https:\/\/avocatmarocain.com\/exequatur-au-maroc\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3344\">public saisissent le tribunal<\/a>, qui d\u00e9signe la personne la plus apte parmi les proches\u202f; \u00e0 d\u00e9faut, il peut choisir une tierce personne ou une institution habilit\u00e9e.\u00a0<\/p>\n<h3><strong>\u00a0Legal definition and purpose of custody\u00a0 <\/strong><\/h3>\n<p>En <a href=\"https:\/\/avocatmarocain.com\/le-mariage-en-droit-marocain\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3336\">Moroccan law<\/a>, la garde n\u2019est pas un privil\u00e8ge parental mais une mission de protection. Le texte associe la Hadana \u00e0 l\u2019\u00e9ducation, \u00e0 la s\u00e9curit\u00e9, \u00e0 la protection morale et aux int\u00e9r\u00eats de l\u2019enfant, plut\u00f4t qu\u2019\u00e0 une simple pr\u00e9rogative du p\u00e8re ou de la m\u00e8re. Cette logique explique pourquoi le juge ne se limite pas \u00e0 une lecture formelle des liens familiaux\u202f: m\u00eame lorsqu\u2019un parent est th\u00e9oriquement prioritaire, le tribunal \u00e9value concr\u00e8tement son aptitude \u00e0 assurer la garde dans l\u2019int\u00e9r\u00eat de l\u2019enfant.\u00a0<\/p>\n<h3><strong>\u00a0The primacy of the best interests of the child\u00a0 <\/strong><\/h3>\n<p>The Family Code repeatedly reminds us that all decisions relating to custody, the choice of guardian, the revision of visitation rights, or the reconsideration of the allocation of assets must be made <strong>in the best interests of the child<\/strong>From the age of fifteen, a child can choose between his father and his mother, provided that this choice remains in his interest and, where applicable, that it is validated by the judge.\u00a0<\/p>\n<p>The <a href=\"https:\/\/avocatmarocain.com\/divorce-dans-la-moudawana\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3345\">juge peut \u00e9galement adapter les modalit\u00e9s de la garde<\/a> et de la visite lorsqu\u2019apparaissent de nouvelles circonstances. Ainsi, la garde n\u2019est jamais fig\u00e9e\u202f: elle demeure soumise \u00e0 un <a href=\"https:\/\/avocatmarocain.com\/mariage-par-procuration-au-maroc\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3337\">contr\u00f4le judiciaire<\/a> constamment orient\u00e9 vers la protection concr\u00e8te du mineur.\u00a0<\/p>\n<h2><strong>\u00a0The order of priority for childcare in Morocco \u00a0<\/strong><\/h2>\n<p>The Family Code establishes a <strong>clear order of priority<\/strong>\u202f:\u00a0<\/p>\n<ol>\n<li><strong>The mother<\/strong><\/li>\n<li><strong>The father<\/strong><\/li>\n<li><strong>The great<\/strong><strong>\u2011m<\/strong><strong>kindergarten<\/strong><\/li>\n<\/ol>\n<p>Failing that, the court awards custody to the closest relative deemed most suitable, always acting in the best interests of the child. This legal hierarchy is not absolute; the judge may intervene if the child's best interests warrant a different solution.\u00a0<\/p>\n<h3><strong>\u00a0Why is the mother<\/strong><strong>-is it a priority<\/strong><strong>\u202f?\u00a0 <\/strong><\/h3>\n<p>The law places the mother at the forefront of the child custody order for reasons of emotional, educational, and material continuity, especially when it concerns a young child who needs sustained daily presence. This priority is not, however, absolute: if the mother does not meet the required conditions, if a change in circumstances is detrimental to the child's best interests, or if a legal ground for termination of custody arises, custody can be transferred to the next person in the order of priority.\u00a0<\/p>\n<h3><strong>\u00a0The role of the father in the Hadana hierarchy\u00a0 <\/strong><\/h3>\n<p>The father occupies the second position, but his role goes beyond the mere possibility of assuming custody: he remains, in principle, the <strong>responsible for the child's care<\/strong>This includes housing, even when custody is granted to the mother. The Code also distinguishes between custody and legal representation; the father remains the legal guardian until he is removed from this role by court order.\u00a0<\/p>\n<h3><strong>\u00a0The place of the grand<\/strong><strong>\u2011m<\/strong><strong>maternal and other relatives\u00a0 <\/strong><\/h3>\n<p>After the parents, the maternal grandmother is expressly mentioned as the third priority beneficiary. If no direct relative can properly exercise the Hadana, the judge first seeks a solution within the immediate family circle before considering a third party or an institution.\u00a0<\/p>\n<h2><strong>\u00a0Conditions required to exercise Hadana's right\u00a0 <\/strong><\/h2>\n<p>The Family Code sets out several requirements:\u00a0<\/p>\n<ul>\n<li><strong>Legal majority<\/strong> for people other than parents.<\/li>\n<li><strong>Rectitude and honesty<\/strong>\u202f: the guard must be morally upright.<\/li>\n<li><strong>Educational capacity<\/strong>\u202f: ability to raise the child, to oversee their schooling and development.<\/li>\n<li><strong>Protection capacity<\/strong>\u202f: to guarantee physical and moral safety.<\/li>\n<li><strong>Decent living conditions<\/strong>\u202f: decent housing, satisfaction of basic material and moral needs.<\/li>\n<li><strong>Sufficient stability<\/strong> so as not to compromise the child's best interests.<\/li>\n<\/ul>\n<p>The text also stipulates that the remarriage of the guardian does not, in itself, constitute grounds for termination of custody, except in certain specific circumstances. In the event of a change in circumstances likely to be detrimental to the child, the guardian may be terminated, with custody then being transferred to the next person in the order of priority.\u00a0<\/p>\n<p>The court may call upon a social worker to draw up a detailed report on the caretaker's accommodation and the child's living conditions, thus confirming that the decision is also based on practical and concrete elements.\u00a0<\/p>\n<h2><strong>\u00a0The visitation and overnight rights of the non-custodial parent\u00a0 <\/strong><\/h2>\n<p>Le parent qui n\u2019a pas la <a href=\"https:\/\/avocatmarocain.com\/avocat-maroc-droit-de-la-famille\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3346\">garde conserve un droit<\/a><strong> de visite et de r\u00e9ception<\/strong>The Code explicitly recognizes this right for both the father and the mother, showing that separation does not break the parental bond.\u00a0<\/p>\n<h3><strong>\u00a0Procedure for setting visiting hours\u00a0 <\/strong><\/h3>\n<p>When the parents reach an agreement, it is presented to the court, which incorporates it into the custody order. If no agreement is reached, the judge determines the times, locations, and duration of visits, taking care to prevent any fraudulent activity. The decision is subject to appeal, allowing for adjustments to an arrangement deemed unsuitable.\u00a0<\/p>\n<h3><strong>\u00a0Father's visitation rights in case of divorce\u00a0 <\/strong><\/h3>\n<p>Le p\u00e8re qui ne d\u00e9tient pas la <a href=\"https:\/\/avocatmarocain.com\/divorce-maroc\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3347\">garde a le droit<\/a> de rendre visite \u00e0 l\u2019enfant et de le recevoir, selon les modalit\u00e9s convenues ou fix\u00e9es judiciairement. Cette droite demeure distincte de la garde\u202f; il n\u2019est pas annul\u00e9 par le fait que la m\u00e8re soit gardienn\u00e9e, et il n\u2019efface pas l\u2019obligation du p\u00e8re d\u2019assurer l\u2019entretien et le logement de l\u2019enfant.\u00a0<\/p>\n<h3><strong>\u00a0Penalties for obstructing visitation rights\u00a0 <\/strong><\/h3>\n<p>If the guardian in bad faith prevents the exercise of visitation rights, the court may review the arrangement, or even order the termination of custody rights when the breach seriously harms the child's interests.\u00a0<\/p>\n<h2><strong>\u00a0Impact of the mother's remarriage on the Hadana\u00a0 <\/strong><\/h2>\n<p>The mother's remarriage does not automatically result in the loss of custody. The Code provides several <strong>exceptions<\/strong>\u202f:\u00a0<\/p>\n<ul>\n<li>The child is under seven years old or separation from the mother would cause harm to the child.<\/li>\n<li>The child has an illness or disability that makes it difficult for another person to care for them.<\/li>\n<li>The new spouse is already a parent of the child or their legal representative.<\/li>\n<li>The mother is herself the legal representative of the<\/li>\n<\/ul>\n<p>The child's age therefore plays a decisive role: the threshold of seven years is explicitly mentioned for exceptions. From the age of fifteen, the child can choose their custodial parent, subject to the judge's supervision.\u00a0<\/p>\n<p>In the event of remarriage, the father remains obligated to pay child support, but he is exempt from the child's housing costs, which remain the responsibility of the mother.\u00a0<\/p>\n<h2><strong>\u00a0When can<\/strong><strong>\u2014to lose or request the withdrawal of custody rights<\/strong><strong>\u202f?\u00a0 <\/strong><\/h2>\n<p>\u00a0<\/p>\n<p>The withdrawal of custody rights may be requested <strong>when the legal conditions are no longer met or when a new fact compromises the child's interests<\/strong>The Code provides for forfeiture in the event of a change likely to harm the child.\u00a0<\/p>\n<h3><strong>\u00a0Negligence and not<\/strong><strong>- Respect for duties <\/strong><strong>educational\u00a0 <\/strong><\/h3>\n<p>The guardian must ensure the child's religious, physical, and moral protection, as well as their education. Serious neglect, educational indifference, or a proven inability to protect the child may justify legal action.\u00a0<\/p>\n<h3><strong>\u00a0Change of residence\u00a0 <\/strong><\/h3>\n<p>Moving within Morocco does not automatically result in the loss of parental rights, but the court examines whether the new distance compromises the child's schooling, ties with the other parent, or well-being.\u00a0<\/p>\n<h3><strong>\u00a0Gross misconduct and fraudulent maneuvers\u00a0 <\/strong><\/h3>\n<p>Conduct that is detrimental to the morals, safety, or best interests of the child may be grounds for a request to terminate custody. Fraudulent maneuvers in the exercise of visitation rights are explicitly provided for as grounds for severe sanctions, which may include the loss of custody.\u00a0<\/p>\n<h2><strong>\u00a0Child support and its link to custody\u00a0 <\/strong><\/h2>\n<p>Child support and custody are <strong>related but legally distinct<\/strong>The Code specifies:\u00a0<\/p>\n<ul>\n<li>The pension covers food, clothing, medical care, education and basic needs.<\/li>\n<li>Providing accommodation for the child in care constitutes a separate obligation, borne by the father, even if he does not have custody.<\/li>\n<li>The remuneration for the guard may be separate, depending on the circumstances.<\/li>\n<\/ul>\n<p>The father must provide for his children until they reach the age of majority, or until they are twenty-five if they are pursuing higher education. Special rules apply to daughters, children with disabilities, or children unable to support themselves.
