Article 13 of the Family Code makes the conclusion of a marriage subject to several essential requirements: the capacity of the spouses, the maintenance of the sadaq (donation), the presence of the wali (governor) when required by law, the recording of consent by two adouls (notaries), and the absence of legal impediments.\u00a0<\/p><h3><strong>\u00a0Marital capacity and legal age\u00a0 <\/strong><\/h3><p>The principle is clear: the age of marriageable capacity is set at 18 years of age, in accordance with the legal majority defined by the Moudawana. This reform established equality between men and women regarding the age of marriage.\u00a0<\/p><p>However, a specific exception exists for the marriage of a minor. This can only take place with the authorization of the family court judge and the approval of the legal representative, attested by signature on the authorization request and by presence during the execution of the marriage certificate. In the event of refusal by the representative, the judge decides.\u00a0<\/p><p>In practice, the age of 18 remains the norm; the exception remains an exceptional measure, strictly controlled.\u00a0<\/p><h3><strong>\u00a0The consent of the spouses\u00a0 <\/strong><\/h3><p>The <a href=\"https:\/\/avocatmarocain.com\/convention-franco-marocaine-statut-personnel\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3316\">mariage marocain<\/a> est avant tout un acte de volont\u00e9. L\u2019article\u202f10 exige un <a href=\"https:\/\/avocatmarocain.com\/avocat-divorce-marocain\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3323\">mutual consent<\/a>, exprim\u00e9 par l\u2019**<strong>consent<\/strong>** and the **<strong>acceptance<\/strong>**, while Article 11 specifies that this consent must be verbal, concurring, formulated immediately, without delay or suspensive or resolutory condition.\u00a0<\/p><p>Thus, a forced or coerced marriage is incompatible with the Moudawana. The Code also stipulates that any marriage tainted by coercion or fraud can be annulled according to Articles 63 and 66.\u00a0<\/p><p>The 2004 reform also abolished mandatory matrimonial guardianship for adult women. Articles 24 and 25 stipulate that the **<strong>district<\/strong>** (management right) belongs to the woman, which she exercises according to her choice and interest; she can conclude her marriage herself or delegate this mission to her father or a close relative.\u00a0<\/p><h3><strong>\u00a0The charity (the dot)\u00a0 <\/strong><\/h3><p>Sadaq is a legal component of marriage. Article 26 defines it as any property given by the husband to his wife, reflecting his firm intention to create a home founded on mutual affection. The text emphasizes its moral value more than its material value.\u00a0<\/p><p>The law prohibits any agreement aimed at eliminating the sadaq, which explains its presence among the conditions for concluding marriage in article 13. Article 27 specifies that it is fixed at the time of the establishment of the act, or, failing that, that its fixing may be delegated to the spouses.\u00a0<\/p><p>Article 30 stipulates that it may be paid in full or in part, in advance or at a later date. In practice, a distinction is made between **<strong>charity<\/strong>** (portion paid immediately) and the **<strong>charity<\/strong>** (delayed part).\u00a0<\/p><p>\u00a0<\/p><p>Two major consequences follow from this:\u00a0<\/p><ul><li>The sadaq becomes the exclusive property of the wife, who can dispose of it freely.<\/li><li>If the marriage is consummated before payment, the remaining amount constitutes a debt of the husband.<\/li><\/ul><p>In the event of a divorce before consummation, the wife is generally entitled to half of the fixed sadaq.\u00a0<\/p><h3><strong>\u00a0No legal impediments\u00a0 <\/strong><\/h3><p>Marriage is valid only if there are no legal impediments. Articles 35 to 39 distinguish between impediments.<strong>perpetual<\/strong>** (direct kinship, prohibited alliances, recent breastfeeding) impediments **<strong>temporary<\/strong>** (simultaneous marriage with two sisters, exceeding the permitted number of wives, marriage during the idd\u00e2 period, marriage of a Muslim woman with a non-Muslim man, etc.).\u00a0<\/p><p>Polygamy is not unrestricted. Articles 40 to 46 subject it to strict control: absence of injustice, objective and exceptional reason, financial capacity of the husband to maintain both households equitably.\u00a0<\/p><h2><strong>\u00a0The administrative procedure with the adouls\u00a0 <\/strong><\/h2><h3><strong>\u00a0Who are the adouls?\u00a0 <\/strong><\/h3><p>The adouls are the officers who record the consent of the spouses and draw up the marriage certificate after authorization from the family court judge. Article 13 expressly requires that consent be recorded by two adouls, and Article 65 specifies that the judge then authorizes the adouls to execute the certificate.\u00a0<\/p><p>Their role is not limited to registering a declaration; they are the guarantors of a document with full probative value. Article 16 stipulates that the marriage certificate constitutes the means of proof of marriage.\u00a0<\/p><h3><strong>\u00a0Required documents\u00a0 <\/strong><\/h3><p>Article 65 lists the documents to be included in the file, which is kept at the registry of the family justice section:\u00a0<\/p><ul><li>Special application form for authorization.<\/li><li>Extract of birth certificate of each fianc\u00e9.<\/li><li>Administrative certificate for each fianc\u00e9.<\/li><li>Medical certificate for each fianc\u00e9.<\/li><li>Marriage authorization where applicable (minor, polygamy, mental disability, conversion to Islam, foreigner).<\/li><li><a href=\"https:\/\/avocatmarocain.com\/mariage-mixte-maroc\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3324\">Certificat d\u2019aptitude au mariage ou \u00e9quivalent pour les \u00e9trangers<\/a>.<\/li><\/ul><p>The adouls must also record the declaration of each fianc\u00e9 regarding his previous civil status (single, divorced, widowed) and attach the corresponding supporting documents.\u00a0<\/p><h3><strong>\u00a0Drafting and approval of the deed\u00a0 <\/strong><\/h3><p>Once the file is complete, the family judge signs it, keeps it under a number, and then the adouls (notaries) draft the document. Article 67 mandates detailed content: mention of the judge's authorization, full identity of the spouses, nationality, consent, name of the wali (governor) if applicable, previous marital status, amount of sadaq (dowry), agreed conditions, required signatures, and then the judge's approval with their seal.\u00a0<\/p><p>\u00a0<\/p><p>After approval, the document is transcribed in the register of the family court section. An extract is sent to the registrar of the spouses' place of birth within 15 days; the original is given to the wife, while a certified copy is issued to the husband.\u00a0<\/p><h2><strong>\u00a0The role of the family judge\u00a0 <\/strong><\/h2><h3><strong>\u00a0Permission for minors\u00a0 <\/strong><\/h3><p>The marriage of a minor requires the intervention of a judge, in addition to the approval of the legal guardian. This dual validation prevents the exception to the legal age from becoming a mere formality. The judge thus acts as guarantor of the exceptional nature of the authorization.\u00a0<\/p><h3><strong>\u00a0Polygamy\u00a0 <\/strong><\/h3><p>The Moudawana (Family Code) significantly restricted polygamy. Article 40 prohibits it when injustice is feared or when a clause in the marriage contract forbids it. Article 41 requires objective and exceptional justification as well as sufficient resources. Articles 42 to 46 establish an adversarial procedure: referral to the court, summons of the first wife, hearings in chambers, examination of the grounds, and, if applicable, informing and obtaining the consent of the prospective second wife. If there are no consular services in Morocco, the copy is sent to the Ministry of Foreign Affairs, and then forwarded to the competent authorities in Morocco.\u00a0<\/p><h2><strong>\u00a0Management of assets between spouses: the separate contract (article 49)\u00a0 <\/strong><\/h2><p>Article 49 of the Moudawana establishes a simple but often misunderstood principle: each spouse retains their own separate property. Marriage, therefore, does not automatically create a community of property.\u00a0<\/p><p>The spouses may, however, agree on a system for sharing or managing the assets acquired during the marriage.
