La Moudawana a cr\u00e9\u00e9 une proc\u00e9dure judiciaire sp\u00e9cifique pour mettre fin \u00e0 un mariage lorsque le conflit entre les \u00e9poux devient durable et que la vie commune devient intol\u00e9rable. Le Tribunal de la famille n\u2019est pas seulement charg\u00e9 de constater la rupture\u202f; il tente d\u2019abord de pr\u00e9server le lien conjugal, puis tranche les questions financi\u00e8res, la garde et l\u2019int\u00e9r\u00eat des enfants.\u00a0<\/p><p>Dans l\u2019esprit du Code de la famille, la <a href=\"https:\/\/avocatmarocain.com\/dissolution-du-mariage\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3289\">dissolution of marriage<\/a> ne doit intervenir qu\u2019exceptionnellement, en privil\u00e9giant le \u00ab\u202fmoindre mal\u202f\u00bb, car elle menace la stabilit\u00e9 familiale et peut nuire aux enfants. C\u2019est dans cette logique que la proc\u00e9dure de divorce\u202fChiqaq a \u00e9t\u00e9 instaur\u00e9e, devenant la r\u00e9ponse juridique aux situations de discorde profonde, d\u2019incompr\u00e9hension persistante ou de rupture de confiance entre conjoints.\u00a0<\/p><h2><strong>What is<\/strong><strong>- what divorce is for discord<\/strong><strong>\u202f?\u00a0 <\/strong><\/h2><p>Chiqaq divorce is a judicial divorce procedure governed by Articles 94 to 97 of the Moudawana (Family Code). It is initiated when one or both spouses request the court to resolve a dispute that could lead to discord. In other words, it is a mechanism allowing a judge to intervene when the marital relationship is severely conflictual and a legal solution appears necessary.\u00a0<\/p><h2><strong>\u00a0Legal basis\u00a0 <\/strong><\/h2><p>Le texte fondateur du divorce\u202fChiqaq se trouve dans le titre\u202fIV du livre\u202fII du Code de la famille, au chapitre consacr\u00e9 au <a href=\"https:\/\/avocatmarocain.com\/divorce-judiciaire\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3301\">Judicial divorce<\/a> pour discorde. L\u2019article\u202f94 impose au tribunal d\u2019entreprendre toutes les tentatives de conciliation pr\u00e9vues \u00e0 l\u2019article\u202f82 avant de prononcer la dissolution du mariage.\u00a0<\/p><p>Le pr\u00e9ambule et le discours royal int\u00e9gr\u00e9s \u00e0 la Moudawana montrent que la r\u00e9forme de\u202f2004 a voulu placer le divorce sous contr\u00f4le judiciaire, accessible tant \u00e0 l\u2019homme qu\u2019\u00e0 la femme, tout en renfor\u00e7ant les m\u00e9canismes de conciliation et d\u2019interm\u00e9diation. Le juge devient ainsi le pivot du processus, garantissant la protection des <a href=\"https:\/\/avocatmarocain.com\/avocat-specialise-en-droit-de-famille-au-maroc\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3290\">droits de l\u2019\u00e9pouse et des enfants<\/a>.\u00a0<\/p><h2><strong>\u00a0Differences from other forms of divorce\u00a0 <\/strong><\/h2><p>It is important to distinguish the Chiqaq divorce from the other methods of dissolution provided for in the Moudawana:\u00a0<\/p><ul><li><strong>Divorce sous <a href=\"https:\/\/avocatmarocain.com\/mariage-par-procuration-au-maroc\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3302\">contr\u00f4le judiciaire<\/a><\/strong> (Articles 78 to 89): procedure for authorising the instrumentation of the divorce, accompanied by an attempt at conciliation and the prior recording of the rights of the wife and children.<\/li><li><strong>Judicial divorce for specific reasons<\/strong> (Article 98): based on specific grounds such as lack of maintenance, absence, latent defect or damage.<\/li><li><strong><a href=\"https:\/\/avocatmarocain.com\/avocat-divorce-marocain\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3293\">Divorce by mutual consent<\/a><\/strong> (Article 114): is based on the agreement of both spouses on the breakdown of the marriage.<\/li><\/ul><p>Chiqaq divorce typically occurs when there is no agreement, when proof of a particular grievance is difficult to establish, or when widespread tension makes living together impossible.\u00a0<\/p><h2><strong>\u00a0Who can request Chiqaq?\u00a0 <\/strong><\/h2><p>One of the major contributions of the reform is equal access to this procedure. Article 94 explicitly addresses \"both spouses or either of them,\" meaning that both husband and wife can file for a Chiqaq divorce. In practice, a woman no longer needs only her husband's consent to leave a conflictual marriage, and a man can no longer dissolve the marriage outside the legal framework established by the Family Court.\u00a0<\/p><h2><strong>\u00a0The steps in the court proceedings\u00a0 <\/strong><\/h2><p>The Chiqaq procedure follows a progressive logic: referral to the court, summons of the spouses, attempt at reconciliation, possible investigation by arbitrators, and then judgment if reconciliation fails. The judge therefore does not immediately grant the divorce; he must first determine whether the separation can be avoided.\u00a0<\/p><ol><li><strong> Filing of the request <\/strong><\/li><\/ol><p>\u00a0\u00a0 The process begins with a petition filed with the competent family court. Articles 94 to 97 do not provide an exhaustive list of required information, but it is clear that the petition must identify the spouses and outline the dispute. It must be clear, chronological, and factual, specifying the points of contention: repeated conflicts, breakdown of cohabitation, verbal abuse, lack of communication, family interference, breaches of marital duties, or a persistent inability to resume living together. This structure complies with Article 95, which tasks arbitrators with investigating the causes of the dispute.\u00a0<\/p><ol start=\"2\"><li><strong> Summons of the spouses <\/strong><\/li><\/ol><p>\u00a0\u00a0 After registration, the spouses are summoned. Proper notification is crucial, as the validity of the procedure depends on respecting the rights of the defense. The rules of Article 81, although relating to divorce under judicial supervision, clarify the procedural logic: if the petitioner fails to appear after being personally summoned, he is considered to have withdrawn his petition; if the wife fails to appear and submits no written observations, the court issues a formal notice to her before ruling. If the address is unknown, the public prosecutor's office is contacted to locate her.\u00a0<\/p><ol start=\"3\"><li><strong> Attempt at reconciliation <\/strong><\/li><\/ol><p>\u00a0\u00a0 The heart of the Chiqaq process lies in conciliation. Article 94 refers to Article 82, stipulating that proceedings are held in chambers, with the possibility of hearing witnesses and other individuals relevant to understanding the conflict. The judge may appoint two arbitrators, consult the family council, or call upon any qualified person. When children are involved, the court must undertake two attempts at conciliation, spaced at least thirty days apart, demonstrating the legislative intent to provide a genuine opportunity for reconciliation before a final separation.\u00a0<\/p><ol start=\"4\"><li><strong> Failure of conciliation and judgment <\/strong><\/li><\/ol><p>\u00a0\u00a0 Si les arbitres ne parviennent pas \u00e0 un accord, ou s\u2019ils ne d\u00e9posent pas leur rapport dans le d\u00e9lai imparti, l\u2019article\u202f96 autorise le tribunal \u00e0 mener une enqu\u00eate compl\u00e9mentaire par tout moyen appropri\u00e9. Le juge retrouve alors une large marge d\u2019appr\u00e9ciation. Lorsque la conciliation devient impossible, l\u2019article\u202f97 stipule clairement\u202f: le tribunal dresse proc\u00e8s\u2011verbal, prononce le <a href=\"https:\/\/avocatmarocain.com\/avocat-en-droit-administratif-marrakech\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3291\">divorce and ruling on rights<\/a> dus, en renvoyant aux articles\u202f83,\u202f84 et\u202f85. Le divorce\u202fChiqaq n\u2019est donc pas un simple constat de m\u00e9sentente\u202f; c\u2019est une d\u00e9cision judiciaire compl\u00e8te qui met fin au mariage et r\u00e8gle les cons\u00e9quences patrimoniales et familiales.\u00a0<\/p><h2><strong>\u00a0Compensation, Mut'a and financial rights\u00a0 <\/strong><\/h2><p>La question des indemnit\u00e9s pour l\u2019\u00e9pouse est souvent source d\u2019inqui\u00e9tude, certains croyant \u00e0 tort qu\u2019un <a href=\"https:\/\/avocatmarocain.com\/divorce-pour-discorde-chiqaq-au-maroc\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3614\">divorce due to discord<\/a> la prive de toute r\u00e9paration. Le Code adopte une approche nuanc\u00e9e\u202f: il oblige le <a href=\"https:\/\/avocatmarocain.com\/peines-alternatives-au-maroc\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3292\">tribunal \u00e0 statuer sur les droits<\/a> de l\u2019\u00e9pouse et des enfants, en tenant compte de la responsabilit\u00e9 de chacun dans les causes du divorce.\u00a0<\/p><p><strong>La Mout'a\u00a0 <\/strong><\/p><p>Article 84 stipulates, among the rights due to the wife, the remaining Sadaq (dowry) if applicable, alimony during the waiting period (Iddah), and a consolation gift (Mout'a). This compensation, intended to be compensatory, partially offsets the effects of the separation. It is assessed according to:\u00a0<\/p><ul><li>the duration of the marriage,<\/li><li>the spouse's financial situation,<\/li><li>the reasons for the divorce,<\/li><li>the degree of proven abuse in the spouse's recourse to divorce.<\/li><\/ul><p>In the context of Chiqaq divorce, Article 97 stipulates that the court must consider each spouse's responsibility when assessing compensation for damages suffered. Therefore, if the discord is primarily attributable to one spouse, the compensation may be adjusted accordingly.\u00a0<\/p><p><strong>Illustrative example\u00a0 <\/strong><\/p><p>Imagine a twelve-year marriage, two children, a wife without a stable income, and a financially well-off husband. If the discord stems primarily from serious breaches of marital duties by the husband, the judge may award a higher Mut'ah, the remaining Sadaq, the Idda allowance, and the cost of temporary housing. Conversely, in a very short marriage, without children, with shared responsibility and the husband's limited resources, the compensation will be more moderate. The Code does not establish a fixed scale; it leaves the judge to make a concrete, individualized assessment based on the specific circumstances of each case.\u00a0<\/p><h2><strong>\u00a0Accommodation during Idda\u00a0 <\/strong><\/h2><p>Article 84 specifies that, during the waiting period, the wife resides in the marital home or, if necessary, in accommodation suited to her financial situation. Failing that, the court determines the amount of accommodation costs, which are recorded among the other rights owed to the wife. This temporary accommodation should not be confused with accommodation for the children, which falls under a separate category.\u00a0<\/p><h2><strong>\u00a0Child support and housing\u00a0 <\/strong><\/h2><p>L\u2019article\u202f85 renvoie aux r\u00e8gles de pension alimentaire, notamment \u00e0 l\u2019article\u202f168, qui stipule que les frais de logement de l\u2019enfant <a href=\"https:\/\/avocatmarocain.com\/avocat-maroc-droit-de-la-famille\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3299\">gard\u00e9 sont distincts de la pension alimentaire<\/a>, de la r\u00e9mun\u00e9ration de garde et des autres frais. Le p\u00e8re doit donc assurer un logement ou en payer le loyer selon l\u2019\u00e9valuation du tribunal. L\u2019enfant gard\u00e9 ne peut \u00eatre contraint \u00e0 quitter le domicile conjugal qu\u2019apr\u00e8s ex\u00e9cution par le p\u00e8re du jugement relatif \u00e0 son logement, garantie essentielle dans les dossiers\u202fChiqaq avec enfants mineurs.\u00a0<\/p><p>\u00a0<\/p><h2><strong>\u00a0Duration of the True procedure\u00a0 <\/strong><\/h2><p>Article 97 requires the court to rule on the action relating to the dispute within a maximum period of six months from the date the application is filed. This period constitutes the legal reference, although, in practice, certain factors may extend it.\u00a0<\/p><h3><strong>\u00a0Factors contributing to lengthening\u00a0 <\/strong><\/h3><ul><li>notification difficulty or address not found<\/li><li>repeated absences of a spouse,<\/li><li>late appointment of referees,<\/li><li>incomplete or late filing of the arbitrators' report,<\/li><li>supplementary investigation ordered under Article 96,<\/li><li>related disputes concerning children, resources, or housing.<\/li><\/ul><p>When children are involved, the law requires two attempts at conciliation spaced at least thirty days apart, which naturally prolongs the procedure.\u00a0<\/p><h2><strong>\u00a0Provisional measures during the proceedings\u00a0 <\/strong><\/h2><p>Article 121 authorizes the court to take provisional measures if cohabitation is impossible during the proceedings. The judge may order that the spouse reside with a close relative of either spouse, a decision that is immediately enforceable by the public prosecutor. These measures quickly protect the wife and stabilize the children's situation while awaiting the final judgment.\u00a0<\/p><h2><strong>\u00a0Legal consequences after the judgment\u00a0 <\/strong><\/h2><p>The Chiqaq divorce decree ends the marital bond and initiates a new phase: the settlement of financial obligations, the organization of custody, visitation rights, and registration with the civil registry. It is not simply the \"end of marriage,\" but a foundational act for the new family structure.\u00a0<\/p><h3><strong>\u00a0Final nature of the judgment\u00a0 <\/strong><\/h3><p>Article 128 stipulates that decisions rendered in judicial divorce, khul', or termination proceedings are not subject to appeal with respect to the part that ends the marital ties. Thus, the dissolution itself cannot be challenged, even if other aspects of the judgment (alimony, custody, etc.) remain subject to ordinary appeals.\u00a0<\/p><h3><strong>\u00a0Child custody and visitation rights\u00a0 <\/strong><\/h3><p>Article 171 places the child's best interests at the heart of post-divorce arrangements: custody is initially granted to the mother, then to the father, then to the maternal grandmother, before the court, if necessary, awards custody to the most suitable relative. Article 88 requires that the judgment specify the children, their ages, the person with custody, and the visitation arrangements. Article 169 reiterates that the father or legal guardian and the custodial mother must ensure the child's education and schooling.\u00a0<\/p><h2><strong>\u00a0Conclusion\u00a0 <\/strong><\/h2><p>The Chiqaq divorce is a central procedure of the Moudawana (Family Code), as it allows the Family Court to address deep-seated conflicts without requiring technical proof of a single, clearly defined fault. The procedure rests on four pillars: a mandatory attempt at reconciliation, the possible intervention of arbitrators, a statutory six-month time limit, and a complete judicial settlement of the rights of the wife and children.\u00a0<\/p><p>Pour le justiciable, l\u2019enjeu ne se limite pas \u00e0 obtenir la dissolution du mariage, mais \u00e0 constituer un dossier solide sur la proc\u00e9dure\u202fChiqaq, la dur\u00e9e du <a href=\"https:\/\/avocatmarocain.com\/mouta\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3303\">divorce et les indemnit\u00e9s auxquelles la femme<\/a> peut pr\u00e9tendre, afin que le jugement prot\u00e8ge au mieux ses int\u00e9r\u00eats et ceux des enfants.
