La Moudawana a cr\u00e9\u00e9 une proc\u00e9dure judiciaire sp\u00e9cifique pour mettre fin \u00e0 un mariage lorsque le conflit entre les \u00e9poux devient durable et que la vie commune devient intol\u00e9rable. Le Tribunal de la famille n\u2019est pas seulement charg\u00e9 de constater la rupture\u202f; il tente d\u2019abord de pr\u00e9server le lien conjugal, puis tranche les questions financi\u00e8res, la garde et l\u2019int\u00e9r\u00eat des enfants.\u00a0<\/p><p>Dans l\u2019esprit du Code de la famille, la <a href=\"https:\/\/avocatmarocain.com\/dissolution-du-mariage\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3289\">Aufl\u00f6sung der Ehe<\/a> ne doit intervenir qu\u2019exceptionnellement, en privil\u00e9giant le \u00ab\u202fmoindre mal\u202f\u00bb, car elle menace la stabilit\u00e9 familiale et peut nuire aux enfants. C\u2019est dans cette logique que la proc\u00e9dure de divorce\u202fChiqaq a \u00e9t\u00e9 instaur\u00e9e, devenant la r\u00e9ponse juridique aux situations de discorde profonde, d\u2019incompr\u00e9hension persistante ou de rupture de confiance entre conjoints.\u00a0<\/p><h2><strong>Was ist<\/strong><strong>- Wozu dient die Scheidung? F\u00fcr Zwietracht<\/strong><strong>\u202f?\u00a0 <\/strong><\/h2><p>Die Chiqaq-Scheidung ist ein gerichtliches Scheidungsverfahren, das in den Artikeln 94 bis 97 des Moudawana (Familiengesetzbuch) geregelt ist. Sie wird eingeleitet, wenn ein oder beide Ehepartner das Gericht um die Beilegung eines Streits bitten, der zu einer Trennung f\u00fchren k\u00f6nnte. Mit anderen Worten: Es handelt sich um einen Mechanismus, der es einem Richter erm\u00f6glicht, einzugreifen, wenn die Ehebeziehung stark konfliktbeladen ist und eine rechtliche L\u00f6sung notwendig erscheint.\u00a0<\/p><h2><strong>\u00a0Rechtsgrundlage\u00a0 <\/strong><\/h2><p>Le texte fondateur du divorce\u202fChiqaq se trouve dans le titre\u202fIV du livre\u202fII du Code de la famille, au chapitre consacr\u00e9 au <a href=\"https:\/\/avocatmarocain.com\/divorce-judiciaire\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3301\">Gerichtliche Scheidung<\/a> pour discorde. L\u2019article\u202f94 impose au tribunal d\u2019entreprendre toutes les tentatives de conciliation pr\u00e9vues \u00e0 l\u2019article\u202f82 avant de prononcer la dissolution du mariage.\u00a0<\/p><p>Le pr\u00e9ambule et le discours royal int\u00e9gr\u00e9s \u00e0 la Moudawana montrent que la r\u00e9forme de\u202f2004 a voulu placer le divorce sous contr\u00f4le judiciaire, accessible tant \u00e0 l\u2019homme qu\u2019\u00e0 la femme, tout en renfor\u00e7ant les m\u00e9canismes de conciliation et d\u2019interm\u00e9diation. Le juge devient ainsi le pivot du processus, garantissant la protection des <a href=\"https:\/\/avocatmarocain.com\/avocat-specialise-en-droit-de-famille-au-maroc\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3290\">droits de l\u2019\u00e9pouse et des enfants<\/a>.\u00a0<\/p><h2><strong>\u00a0Unterschiede zu anderen Scheidungsformen\u00a0 <\/strong><\/h2><p>Es ist wichtig, die Chiqaq-Scheidung von den anderen im Moudawana vorgesehenen Scheidungsmethoden zu unterscheiden:\u00a0<\/p><ul><li><strong>Divorce sous <a href=\"https:\/\/avocatmarocain.com\/mariage-par-procuration-au-maroc\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3302\">contr\u00f4le judiciaire<\/a><\/strong> (Artikel 78 bis 89): Verfahren zur Genehmigung der Durchf\u00fchrung der Scheidungsakte, verbunden mit einem Schlichtungsversuch und der vorherigen Eintragung der Rechte der Ehefrau und der Kinder.<\/li><li><strong>Gerichtliche Scheidung aus bestimmten Gr\u00fcnden<\/strong> (Artikel 98): aufgrund bestimmter Gr\u00fcnde wie mangelnde Instandhaltung, Abwesenheit, versteckter Mangel oder Besch\u00e4digung.<\/li><li><strong><a href=\"https:\/\/avocatmarocain.com\/avocat-divorce-marocain\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3293\">Scheidung im gegenseitigen Einvernehmen<\/a><\/strong> (Artikel 114): basiert auf der \u00dcbereinkunft beider Ehegatten \u00fcber die Aufl\u00f6sung der Ehe.<\/li><\/ul><p>Eine Scheidung nach dem Chiqaq-Prinzip erfolgt typischerweise dann, wenn keine Einigung erzielt werden kann, wenn es schwierig ist, einen bestimmten Grund f\u00fcr die Unzufriedenheit nachzuweisen, oder wenn weit verbreitete Spannungen ein Zusammenleben unm\u00f6glich machen.\u00a0<\/p><h2><strong>\u00a0Wer kann Chiqaq anfordern?\u00a0 <\/strong><\/h2><p>Eine der wichtigsten Errungenschaften der Reform ist der gleichberechtigte Zugang zu diesem Verfahren. Artikel 94 spricht ausdr\u00fccklich von \u201ebeide Ehegatten oder einem von ihnen\u201c, was bedeutet, dass sowohl Ehemann als auch Ehefrau eine Chiqaq-Scheidung beantragen k\u00f6nnen. In der Praxis ben\u00f6tigt eine Frau nicht mehr allein die Zustimmung ihres Ehemannes, um eine konfliktbeladene Ehe zu beenden, und ein Mann kann die Ehe nicht mehr au\u00dferhalb des vom Familiengericht festgelegten rechtlichen Rahmens aufl\u00f6sen.\u00a0<\/p><h2><strong>\u00a0Die Schritte im Gerichtsverfahren\u00a0 <\/strong><\/h2><p>Das Chiqaq-Verfahren folgt einer schrittweisen Logik: Anrufung des Gerichts, Vorladung der Ehegatten, Vers\u00f6hnungsversuch, m\u00f6gliche Untersuchung durch Schiedsrichter und schlie\u00dflich Urteil, falls die Vers\u00f6hnung scheitert. Der Richter spricht die Scheidung daher nicht sofort aus; er muss zun\u00e4chst pr\u00fcfen, ob die Trennung vermieden werden kann.\u00a0<\/p><ol><li><strong> Einreichung des Antrags <\/strong><\/li><\/ol><p>\u00a0\u00a0 Das Verfahren beginnt mit einem Antrag beim zust\u00e4ndigen Familiengericht. Die Artikel 94 bis 97 enthalten keine abschlie\u00dfende Liste der erforderlichen Angaben, doch es ist klar, dass der Antrag die Ehegatten identifizieren und den Streitgegenstand darlegen muss. Er muss klar, chronologisch und sachlich sein und die Streitpunkte genau benennen: wiederholte Konflikte, Scheitern des Zusammenlebens, verbale \u00dcbergriffe, mangelnde Kommunikation, Einmischung der Familie, Verletzung ehelicher Pflichten oder die anhaltende Unf\u00e4higkeit, das Zusammenleben wieder aufzunehmen. Diese Struktur entspricht Artikel 95, der die Schiedsrichter mit der Untersuchung der Streitursachen beauftragt.\u00a0<\/p><ol start=\"2\"><li><strong> Vorladung der Ehegatten <\/strong><\/li><\/ol><p>\u00a0\u00a0 Nach der Registrierung werden die Ehegatten vorgeladen. Eine ordnungsgem\u00e4\u00dfe Benachrichtigung ist von entscheidender Bedeutung, da die G\u00fcltigkeit des Verfahrens von der Wahrung der Verteidigungsrechte abh\u00e4ngt. Die Bestimmungen des Artikels 81, die sich zwar auf die Scheidung unter gerichtlicher Aufsicht beziehen, verdeutlichen die Verfahrenslogik: Erscheint der Antragsteller nach pers\u00f6nlicher Vorladung nicht, gilt sein Antrag als zur\u00fcckgezogen; erscheint die Ehefrau nicht und reicht keine schriftliche Stellungnahme ein, erl\u00e4sst das Gericht ihr vor der Entscheidung eine f\u00f6rmliche Benachrichtigung. Ist ihre Adresse unbekannt, wird die Staatsanwaltschaft kontaktiert, um sie ausfindig zu machen.\u00a0<\/p><ol start=\"3\"><li><strong> Vers\u00f6hnungsversuch <\/strong><\/li><\/ol><p>\u00a0\u00a0 Kern des Chiqaq-Verfahrens ist die Schlichtung. Artikel 94 verweist auf Artikel 82 und legt fest, dass die Verhandlung unter Ausschluss der \u00d6ffentlichkeit stattfindet, wobei Zeugen und andere f\u00fcr das Verst\u00e4ndnis des Konflikts relevante Personen angeh\u00f6rt werden k\u00f6nnen. Der Richter kann zwei Schlichter ernennen, den Familienrat konsultieren oder jede qualifizierte Person hinzuziehen. Sind Kinder betroffen, muss das Gericht zwei Schlichtungsversuche im Abstand von mindestens drei\u00dfig Tagen unternehmen, um die gesetzgeberische Absicht zu verdeutlichen, vor einer endg\u00fcltigen Trennung eine echte Chance auf Vers\u00f6hnung zu bieten.\u00a0<\/p><ol start=\"4\"><li><strong> Scheitern von Schlichtung und Urteil <\/strong><\/li><\/ol><p>\u00a0\u00a0 Si les arbitres ne parviennent pas \u00e0 un accord, ou s\u2019ils ne d\u00e9posent pas leur rapport dans le d\u00e9lai imparti, l\u2019article\u202f96 autorise le tribunal \u00e0 mener une enqu\u00eate compl\u00e9mentaire par tout moyen appropri\u00e9. Le juge retrouve alors une large marge d\u2019appr\u00e9ciation. Lorsque la conciliation devient impossible, l\u2019article\u202f97 stipule clairement\u202f: le tribunal dresse proc\u00e8s\u2011verbal, prononce le <a href=\"https:\/\/avocatmarocain.com\/avocat-en-droit-administratif-marrakech\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3291\">Scheidung und Urteil \u00fcber Rechte<\/a> dus, en renvoyant aux articles\u202f83,\u202f84 et\u202f85. Le divorce\u202fChiqaq n\u2019est donc pas un simple constat de m\u00e9sentente\u202f; c\u2019est une d\u00e9cision judiciaire compl\u00e8te qui met fin au mariage et r\u00e8gle les cons\u00e9quences patrimoniales et familiales.\u00a0<\/p><h2><strong>\u00a0Entsch\u00e4digung, Mut'a und finanzielle Rechte\u00a0 <\/strong><\/h2><p>La question des indemnit\u00e9s pour l\u2019\u00e9pouse est souvent source d\u2019inqui\u00e9tude, certains croyant \u00e0 tort qu\u2019un divorce pour discorde la prive de toute r\u00e9paration. Le Code adopte une approche nuanc\u00e9e\u202f: il oblige le <a href=\"https:\/\/avocatmarocain.com\/peines-alternatives-au-maroc\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3292\">tribunal \u00e0 statuer sur les droits<\/a> de l\u2019\u00e9pouse et des enfants, en tenant compte de la responsabilit\u00e9 de chacun dans les causes du divorce.\u00a0<\/p><p><strong>La Mout'a\u00a0 <\/strong><\/p><p>Artikel 84 sieht unter anderem folgende Rechte f\u00fcr die Ehefrau vor: die gegebenenfalls verbleibende Sadaq (Mitgift), Unterhalt w\u00e4hrend der Wartezeit (Iddah) und eine Entsch\u00e4digung (Mout'a). Diese Entsch\u00e4digung soll die Folgen der Trennung teilweise ausgleichen. Sie wird wie folgt berechnet:\u00a0<\/p><ul><li>die Dauer der Ehe,<\/li><li>die finanzielle Situation des Ehepartners,<\/li><li>die Gr\u00fcnde f\u00fcr die Scheidung<\/li><li>das Ausma\u00df des nachgewiesenen Missbrauchs im Scheidungsverfahren des Ehepartners.<\/li><\/ul><p>Im Kontext der Scheidung nach Chiqaq-Recht legt Artikel 97 fest, dass das Gericht bei der Bemessung des Schadensersatzes die Verantwortung beider Ehepartner ber\u00fccksichtigen muss. Ist die Streitigkeit haupts\u00e4chlich einem Ehepartner zuzuschreiben, kann der Schadensersatz entsprechend angepasst werden.\u00a0<\/p><p><strong>Veranschaulichendes Beispiel\u00a0 <\/strong><\/p><p>Stellen Sie sich eine zw\u00f6lfj\u00e4hrige Ehe mit zwei Kindern vor, eine Ehefrau ohne festes Einkommen und einen finanziell gut situierten Ehemann. Beruht der Streit haupts\u00e4chlich auf schwerwiegenden Pflichtverletzungen des Ehemanns, kann der Richter eine h\u00f6here Mut'a, die verbleibende Sadaq, die Idda-Beihilfe und die Kosten f\u00fcr eine vor\u00fcbergehende Unterkunft zusprechen. Umgekehrt f\u00e4llt die Entsch\u00e4digung in einer sehr kurzen Ehe ohne Kinder, mit geteilter Verantwortung und begrenzten Mitteln des Ehemanns moderater aus. Das Gesetz sieht keine feste Skala vor; es \u00fcberl\u00e4sst dem Richter eine konkrete, individuelle Beurteilung anhand der jeweiligen Umst\u00e4nde des Einzelfalls.\u00a0<\/p><h2><strong>\u00a0Unterkunft w\u00e4hrend des Idda\u00a0 <\/strong><\/h2><p>Artikel 84 sieht vor, dass die Ehefrau w\u00e4hrend der Wartezeit im ehelichen Wohnsitz oder, falls erforderlich, in einer ihren finanziellen M\u00f6glichkeiten angemessenen Unterkunft wohnt. Andernfalls setzt das Gericht die H\u00f6he der Unterkunftskosten fest, die zu den \u00fcbrigen der Ehefrau zustehenden Rechten gez\u00e4hlt werden.
