Sie beschr\u00e4nkt sich nicht auf einen einfachen monatlichen Betrag: Sie verk\u00f6rpert den Schutz der Familie, das soziale Gleichgewicht und die Wirksamkeit der gerichtlichen Durchsetzung.\u00a0<\/p><p>Anders als oft angenommen, gibt es keine einheitliche, automatische Berechnungsmethode. Der Richter legt die H\u00f6he des Schadensersatzes im Einzelfall fest und ber\u00fccksichtigt dabei die finanziellen Mittel des Schuldners, die Bed\u00fcrfnisse des Gl\u00e4ubigers, die Lebenshaltungskosten und soziale Gepflogenheiten. Dieser Ansatz macht die Angelegenheit sowohl technisch als auch zutiefst menschlich.\u00a0<\/p><h2><strong>\u00a0Einf\u00fchrung\u00a0 <\/strong><\/h2><p>En <a href=\"https:\/\/avocatmarocain.com\/divorce-marocain\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3282\">droit marocain<\/a>, Die <strong>Zuschuss<\/strong> Dies bezieht sich auf die rechtliche Unterhaltspflicht, insbesondere zwischen Ehepartnern und zum Wohle der Kinder. Die Moudawana legt fest, dass diese Pflicht aus Ehe, Verwandtschaft und Treue entsteht und Nahrung, Kleidung, medizinische Versorgung, Kindererziehung und alles andere umfasst, was \u00fcblicherweise als lebensnotwendig gilt.\u00a0<\/p><p>La pension alimentaire occupe une place centrale dans les contentieux familiaux, car elle touche \u00e0 la stabilit\u00e9 mat\u00e9rielle des enfants, \u00e0 la dignit\u00e9 de l\u2019\u00e9pouse et \u00e0 l\u2019ex\u00e9cution concr\u00e8te des <a href=\"https:\/\/avocatmarocain.com\/avocat-en-droit-administratif-marrakech\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3270\">droits apr\u00e8s s\u00e9paration ou divorce<\/a>. Le <a href=\"https:\/\/avocatmarocain.com\/motaa-au-maroc\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3268\">Familienkodex<\/a> a d\u2019ailleurs renforc\u00e9 cette protection en instituant une justice de la famille sp\u00e9cialis\u00e9e et en imposant un traitement rapide des litiges relatifs \u00e0 la pension.\u00a0<\/p><p>Le justiciable recherche souvent un chiffre pr\u00e9cis, alors que la loi raisonne en crit\u00e8res, non en forfaits. Ainsi, le montant de la pension alimentaire par <a href=\"https:\/\/avocatmarocain.com\/avocat-specialise-en-droit-de-famille-au-maroc\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3269\">enfant au Maroc<\/a> n\u2019est jamais fixe\u202f: il d\u00e9pend d\u2019un examen individualis\u00e9 du dossier, des preuves produites et du pouvoir d\u2019appr\u00e9ciation du juge.\u00a0<\/p><h2><strong>\u00a0Die Bestandteile des Kindesunterhalts\u00a0 <\/strong><\/h2><h3><strong>\u00a0Grundbed\u00fcrfnisse des Kindes\u00a0 <\/strong><\/h3><p>Artikel 189 legt fest, dass der Unterhalt Nahrung, Kleidung, medizinische Versorgung, Bildung und alles Weitere, was notwendig ist, umfasst. In der Praxis deckt die Beihilfe die grundlegenden Lebenshaltungskosten sowie die \u00fcbliche Gesundheitsversorgung, Hygiene und den t\u00e4glichen Lebensunterhalt ab. Der Richter ber\u00fccksichtigt dabei Alter, Gesundheitszustand und soziale Umst\u00e4nde des Kindes: Ein S\u00e4ugling, ein Jugendlicher im Schulalter oder ein Kind mit Behinderung haben unterschiedliche Bed\u00fcrfnisse.\u00a0<\/p><h3><strong>\u00a0Unterkunft\u00a0 <\/strong><\/h3><p>L\u2019article 168 distingue clairement la pension <a href=\"https:\/\/avocatmarocain.com\/avocat-maroc-droit-de-la-famille\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3278\">alimentaire des frais de logement de l\u2019enfant gard\u00e9<\/a>. Le parent d\u00e9biteur peut donc \u00eatre tenu de verser, en plus de la nafaqa, une indemnit\u00e9 autonome pour le logement ou de payer le loyer fix\u00e9 par le tribunal. L\u2019enfant ne peut \u00eatre contraint de quitter le domicile conjugal qu\u2019apr\u00e8s l\u2019ex\u00e9cution du jugement relatif \u00e0 son logement.\u00a0<\/p><h3><strong>\u00a0Schulung\u00a0 <\/strong><\/h3><p>Die Ausbildung der Kinder ist ausdr\u00fccklich in den Unterhalt einbezogen (Art. 189). Anmeldegeb\u00fchren, Schulmaterialien und \u00fcbliche Schulkosten werden daher ber\u00fccksichtigt, sofern sie dem bisherigen Lebensstandard des Kindes entsprechen. Im Falle einer Scheidung bestimmt Artikel 85, dass die Rentenanspr\u00fcche auf den Lebensverh\u00e4ltnissen und dem Bildungsstand vor der Trennung basieren, um einen pl\u00f6tzlichen Zusammenbruch des Lebensstandards zu vermeiden.\u00a0<\/p><h3><strong>\u00a0Ehefrauenrente\u00a0 <\/strong><\/h3><p>Die Regelungen zum Ehegattenunterhalt unterscheiden sich von denen zum Kinderunterhalt. Der Ehemann ist ab dem Zeitpunkt der Eheschlie\u00dfung zur Zahlung von Unterhalt f\u00fcr seine Ehefrau verpflichtet. Dieses Recht bleibt auch dann bestehen, wenn die Ehe erst nach der Eheschlie\u00dfung vollzogen wird. Im Falle einer Scheidung kann die Ehefrau w\u00e4hrend der Wartezeit (der Trauerzeit) Unterhalt erhalten; der verbleibende Betrag wird anschlie\u00dfend an ihren Ehemann ausgezahlt. <strong>Wohlt\u00e4tigkeit<\/strong> und gegebenenfalls auch die Wohnkosten. Ist die Scheidung endg\u00fcltig und die Ex-Frau schwanger, wird der Unterhalt bis zur Geburt gezahlt; andernfalls beschr\u00e4nkt er sich bis zum Ende der Schwangerschaft auf die Wohnkosten.<strong>Sie<\/strong>.\u00a0<\/p><h2><strong>\u00a0Wie der Richter den Betrag festlegt\u00a0 <\/strong><\/h2><p>Artikel 190 der Moudawana besagt, dass sich das Gericht auf die Aussagen der Parteien, die vorgelegten Beweismittel und gegebenenfalls auf die Meinung von Sachverst\u00e4ndigen st\u00fctzt.\u00a0<\/p><h3><strong>\u00a0Einkommen des Schuldners\u00a0 <\/strong><\/h3><p>Artikel 189 legt fest, dass die Berechnung der Unterhaltskosten auf einem Durchschnitt des Einkommens des Schuldners, der Situation des Gl\u00e4ubigers, der Lebenshaltungskosten und der gesellschaftlichen Normen beruht. Der Richter pr\u00fcft Geh\u00e4lter, Mieteinnahmen, berufliche Ressourcen und allgemein Indikatoren f\u00fcr den tats\u00e4chlichen Lebensstandard. Ein Schuldner, der ein geringes Einkommen angibt, aber einen hohen Lebensstandard aufrechterh\u00e4lt, kann sich seinen Verpflichtungen daher nicht entziehen.\u00a0<\/p><h3><strong>\u00a0Bed\u00fcrfnisse des Gl\u00e4ubigers\u00a0 <\/strong><\/h3><p>Le cr\u00e9ancier peut \u00eatre l\u2019\u00e9pouse, l\u2019enfant ou, dans certains cas, les parents. Pour les enfants, le juge consid\u00e8re l\u2019\u00e2ge, la sant\u00e9, le niveau scolaire, les besoins quotidiens et les conditions de vie ant\u00e9rieures. Pour l\u2019\u00e9pouse, le <a href=\"https:\/\/avocatmarocain.com\/avocat-safi\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3271\">droit d\u00e9pend du cadre matrimonial et de la situation juridique<\/a> du divorce. La protection des enfants s\u2019\u00e9tend g\u00e9n\u00e9ralement jusqu\u2019\u00e0 la majorit\u00e9\u202f; elle peut se prolonger jusqu\u2019\u00e0 25\u202fans pour les \u00e9tudes sup\u00e9rieures, voire au-del\u00e0 pour les enfants handicap\u00e9s.\u00a0<\/p><h3><strong>\u00a0Keine offizielle Skala\u00a0 <\/strong><\/h3><p>Il n\u2019existe pas de grille nationale imposant un montant uniforme de <a href=\"https:\/\/avocatmarocain.com\/fin-de-la-pension-alimentaire-au-maroc\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3279\">pension alimentaire par enfant<\/a>. Le juge exerce un pouvoir d\u2019appr\u00e9ciation, encadr\u00e9 par les articles\u202f189 et\u202f190, et peut recourir \u00e0 des experts pour affiner l\u2019\u00e9valuation des revenus ou des besoins. Cette absence de bar\u00e8me n\u2019est pas un vide juridique, mais le r\u00e9sultat d\u2019un choix l\u00e9gislatif favorisant une appr\u00e9ciation individualis\u00e9e plut\u00f4t qu\u2019un automatisme parfois injuste.\u00a0<\/p><h2><strong>\u00a0Verfahren vor dem Familiengericht\u00a0 <\/strong><\/h2><p>\u00a0<\/p><p>Les demandes de <a href=\"https:\/\/avocatmarocain.com\/avocat-specialise-en-droit-de-famille\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3281\">pension alimentaire rel\u00e8vent de la justice de la famille<\/a>. Le Code de proc\u00e9dure civile modifi\u00e9 pr\u00e9voit que ces demandes sont trait\u00e9es en r\u00e9f\u00e9r\u00e9, avec des d\u00e9cisions ex\u00e9cutoires sur minute, m\u00eame en cas de recours.\u00a0<\/p><h3><strong>\u00a0Rechtliche Schritte\u00a0 <\/strong><\/h3><ol><li>Einreichung eines Antrags beim zust\u00e4ndigen Gericht.<\/li><li>Vorlage von Unterlagen, die den Anspruch auf eine Rente und die geltend gemachten Bed\u00fcrfnisse begr\u00fcnden.<\/li><li>Die Parteien werden vorgeladen und die Akte wird gepr\u00fcft.<\/li><li>Der Richter hat die M\u00f6glichkeit, schnell eine vorl\u00e4ufige Rente festzusetzen.<\/li><li>Urteil in der Sache mit Feststellung des Betrags, der Vollstreckungsbedingungen und gegebenenfalls der Sicherheiten.<\/li><\/ol><p>Der Richter muss innerhalb eines H\u00f6chstzeitraums von einem Monat entscheiden; diese Schnelligkeit stellt eine der wichtigsten Neuerungen des Moudawana dar.\u00a0<\/p><h3><strong>\u00a0Erforderliche Dokumente\u00a0 <\/strong><\/h3><ul><li>Acte de <a href=\"https:\/\/avocatmarocain.com\/faq-droit-de-la-famille-au-maroc\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3272\">mariage ou jugement de divorce<\/a>.<\/li><li>Geburtsurkunden von Kindern.<\/li><li>Nachweis \u00fcber das Einkommen des Schuldners (Gehaltsabrechnungen, Kontoausz\u00fcge usw.).<\/li><li>Unterlagen zu den Ausgaben des Kindes (Arztrechnungen, Schulgeb\u00fchren).<\/li><li>Dokumente, die die Einstellung der Instandhaltung oder etwaige Zahlungsr\u00fcckst\u00e4nde belegen.<\/li><\/ul><p>Je vollst\u00e4ndiger die Akte, desto pr\u00e4ziser und angemessener wird die Entscheidung ausfallen.\u00a0<\/p><h3><strong>\u00a0Vorl\u00e4ufige Rente\u00a0 <\/strong><\/h3><p>L\u2019article\u202f179\u2011bis du <a href=\"https:\/\/avocatmarocain.com\/le-mariage-en-droit-marocain\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3280\">Code de proc\u00e9dure civile autorise le juge<\/a>, dans le mois suivant la demande, \u00e0 ordonner une pension alimentaire provisoire en fonction du bien\u2011fond\u00e9 de la demande et des preuves pr\u00e9sent\u00e9es. Cette mesure urgente prot\u00e8ge les familles qui ne peuvent pas attendre plusieurs mois sans ressources.\u00a0<\/p><h2><strong>\u00a0Rechtsbehelfe im Falle der Nicht-<\/strong><strong>-Zahlung\u00a0 <\/strong><\/h2><h3><strong>\u00a0Zwangsvollstreckung\u00a0 <\/strong><\/h3><p>Artikel 191 erm\u00e4chtigt das Gericht, die Mittel zur Vollstreckung des Urteils festzulegen: Lohnpf\u00e4ndung, Verm\u00f6gensbeschlagnahme oder jede andere der Situation des Schuldners angemessene Ma\u00dfnahme. Das Urteil bleibt so lange in Kraft, bis es durch ein anderes Urteil ersetzt wird oder der Anspruch auf die Rente rechtm\u00e4\u00dfig erlischt.\u00a0<\/p><h3><strong>\u00a0Verbrechen der Familienaussetzung\u00a0 <\/strong><\/h3><p>Artikel 202 legt fest, dass die Nichtzahlung von mehr als einem Monat eine Vernachl\u00e4ssigung der Familie darstellt und strafbar ist. Diese Bestimmung erh\u00f6ht den Druck auf s\u00e4umige Schuldner, ersetzt jedoch nicht die Vollstreckungsma\u00dfnahmen.\u00a0<\/p><h3><strong>\u00a0Familienunterst\u00fctzungsfonds\u00a0 <\/strong><\/h3><p>Der Text erw\u00e4hnt die Einrichtung eines Familienunterst\u00fctzungsfonds, der die Umsetzung des Familiengesetzbuches f\u00f6rdern soll.
