marokkanischem Recht<\/strong> Es handelt sich um einen auf gegenseitigem Einvernehmen beruhenden Pakt, der darauf abzielt, eine rechtliche und dauerhafte Verbindung zwischen Mann und Frau zu begr\u00fcnden. Dieser feierliche Vertrag ist nicht blo\u00df eine administrative Formalit\u00e4t, sondern definiert den rechtlichen Rahmen der Familieneinheit unter der Leitung beider Ehepartner. Das Verst\u00e4ndnis der Bestimmungen des <strong>Marokkanisches Familiengesetzbuch<\/strong> est essentiel pour garantir la protection des <a href=\"https:\/\/avocatmarocain.com\/avocat-specialise-en-droit-de-famille-au-maroc\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3072\">droits de chaque conjoint et la filiation des enfants<\/a>.<\/p><h2>Bedingungen f\u00fcr die G\u00fcltigkeit einer Ehe nach marokkanischem Recht gem\u00e4\u00df der Moudawana<\/h2><p>L'<strong>Artikel 13 des Familiengesetzbuches<\/strong> Der Abschluss eines Ehevertrages unterliegt der Erf\u00fcllung zwingender formeller und materieller Voraussetzungen. Die Nichteinhaltung dieser Voraussetzungen kann zur Annullierung der Ehe oder zu ihrer Einstufung als ung\u00fcltige Ehe f\u00fchren.<\/p><h3>Eheliche F\u00e4higkeit und Zustimmung der Parteien<\/h3><p>L'<strong>Artikel 19 der Moudawana<\/strong> legt fest, dass die Ehef\u00e4higkeit erworben wird bei <strong>achtzehn Jahre alt<\/strong> Gregorianische Ges\u00e4nge sind f\u00fcr M\u00e4nner und Frauen \u00fcberholt. Das marokkanische Recht erlaubt es jedoch einem Familienrichter, die Heirat eines Minderj\u00e4hrigen nach einer Sozialuntersuchung oder medizinischen Untersuchung und begr\u00fcndeter Entscheidung zu genehmigen (Art. 20).<\/p><p>Le consentement est le pilier central du <a href=\"https:\/\/avocatmarocain.com\/contrat-de-mariage-au-maroc\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3069\">Ehevertrag in Marokko<\/a>. Selon l\u2019<strong>Artikel 10<\/strong>, le mariage est conclu par le <a href=\"https:\/\/avocatmarocain.com\/avocat-divorce-marocain\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3079\">gegenseitige Zustimmung<\/a> (<em>Zustimmung<\/em> und <em>Qaboul<\/em>) in festgelegten Begriffen oder im Falle der Gesch\u00e4ftsunf\u00e4higkeit durch ein verst\u00e4ndliches Zeichen ausgedr\u00fcckt (Art. 11).<\/p><h3>Rolle des Wali und Festlegung der Sadaq (Mitgift)<\/h3><p>L'<strong>Artikel 24 des Moudawana<\/strong> legt fest, dass die eheliche Vormundschaft (<em>Bezirk<\/em>) est un <a href=\"https:\/\/avocatmarocain.com\/avocat-en-droit-administratif-marrakech\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3078\">droit appartenant \u00e0 la femme<\/a> majeure. Cette derni\u00e8re exerce ce droit selon son choix et peut contracter elle-m\u00eame son mariage ou d\u00e9l\u00e9guer cette mission \u00e0 son p\u00e8re ou \u00e0 un proche (Art. 25).<\/p><p>Le <strong>Sadaq (die Mitgift)<\/strong> umfasst jegliches Verm\u00f6gen, das der Ehemann seiner Ehefrau als Zeichen seines Willens zur Errichtung eines gemeinsamen Haushalts schenkt (Art. 26).<strong>Artikel 28<\/strong> legt fest, dass der Betrag moderat sein sollte, w\u00e4hrend der<strong>Artikel 29<\/strong> best\u00e4tigt, dass die Mitgift in das ausschlie\u00dfliche Eigentum der Ehefrau \u00fcbergeht.<\/p><p><img decoding=\"async\" class=\"aligncenter wp-image-5103 size-full\" src=\"https:\/\/avocatmarocain.com\/wp-content\/uploads\/2026\/03\/validation-mariage-civil-francais-au-Maroc.webp\" alt=\"Anerkennung franz\u00f6sischer Zivilehen in Marokko\" width=\"1536\" height=\"1024\" srcset=\"https:\/\/avocatmarocain.com\/wp-content\/uploads\/2026\/03\/validation-mariage-civil-francais-au-Maroc.webp 1536w, https:\/\/avocatmarocain.com\/wp-content\/uploads\/2026\/03\/validation-mariage-civil-francais-au-Maroc-300x200.webp 300w, https:\/\/avocatmarocain.com\/wp-content\/uploads\/2026\/03\/validation-mariage-civil-francais-au-Maroc-1024x683.webp 1024w, https:\/\/avocatmarocain.com\/wp-content\/uploads\/2026\/03\/validation-mariage-civil-francais-au-Maroc-768x512.webp 768w, https:\/\/avocatmarocain.com\/wp-content\/uploads\/2026\/03\/validation-mariage-civil-francais-au-Maroc-18x12.webp 18w\" sizes=\"(max-width: 1536px) 100vw, 1536px\" \/><\/p><h2>Notarielle Formalit\u00e4ten und Ausstellung der Heiratsurkunde<\/h2><p>Die Ausstellung einer Heiratsurkunde in Marokko folgt einem strengen Verwaltungsverfahren, bevor die <strong>Section de la justice de la <a href=\"https:\/\/avocatmarocain.com\/procedure-de-divorce-au-maroc\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3073\">Familie<\/a><\/strong>Das Eingreifen der beiden <em>erwachsen<\/em> ist zwingend erforderlich, um die Zustimmung einzuholen und das offizielle Dokument aufzusetzen.<\/p><p>L'<strong>Artikel 65 des Familiengesetzbuches<\/strong> erfordert die Erstellung einer Datei, die folgende Dokumente enth\u00e4lt:<\/p><ul><li>Ein spezielles Antragsformular zur Erteilung der Genehmigung zur Ausf\u00fchrung des Rechtsakts.<\/li><li>Ein Auszug aus der Geburtsurkunde jedes Verlobten.<\/li><li>Ein \u00e4rztliches Attest, das die Abwesenheit ansteckender Krankheiten bescheinigt.<\/li><li>Genehmigung des Richters f\u00fcr besondere F\u00e4lle (Minderj\u00e4hrige, Polygamie, Konvertiten).<\/li><\/ul><p>Nach Genehmigung durch den Richter wird das Dokument in ein spezielles Register eingetragen und ein Auszug wird innerhalb von 15 Tagen an den Standesbeamten des Geburtsortes der Ehegatten gesendet (Art. 68).<\/p><h2>Der rechtliche Rahmen f\u00fcr Polygamie in Marokko: Bedingungen und gerichtliche Genehmigung<\/h2><p>L\u2019<strong>Artikel 40 der Moudawana<\/strong> Polygamie ist verboten, wenn die Gefahr einer Ungerechtigkeit gegen\u00fcber den Ehefrauen besteht oder wenn im Ehevertrag eine Klausel gegen Polygamie enthalten ist. Diese Praxis ist heutzutage die Ausnahme und unterliegt der gerichtlichen Aufsicht.<\/p><p>Das Gericht erteilt die Genehmigung nur, wenn beide der folgenden kumulativen Bedingungen erf\u00fcllt sind:<strong>Artikel 41<\/strong> sind ausgef\u00fcllt:<\/p><ol><li>Die Begr\u00fcndung einer objektiven und au\u00dfergew\u00f6hnlichen Rechtfertigung.<\/li><li>Nachweis ausreichender Ressourcen, um den Bed\u00fcrfnissen beider Haushalte gleicherma\u00dfen gerecht zu werden.<\/li><\/ol><p>Die jetzige Ehefrau muss vom Gericht vorgeladen werden, um ihre Meinung zu \u00e4u\u00dfern, und die zuk\u00fcnftige Ehefrau muss dar\u00fcber informiert werden, dass der Mann bereits verheiratet ist (Art. 43, 46).<\/p><p><img decoding=\"async\" class=\"aligncenter wp-image-5104 size-full\" src=\"https:\/\/avocatmarocain.com\/wp-content\/uploads\/2026\/03\/polygamie-Maroc-autorisation-juge.webp\" alt=\"Polygamie in Marokko mit gerichtlicher Genehmigung\" width=\"1536\" height=\"1024\" srcset=\"https:\/\/avocatmarocain.com\/wp-content\/uploads\/2026\/03\/polygamie-Maroc-autorisation-juge.webp 1536w, https:\/\/avocatmarocain.com\/wp-content\/uploads\/2026\/03\/polygamie-Maroc-autorisation-juge-300x200.webp 300w, https:\/\/avocatmarocain.com\/wp-content\/uploads\/2026\/03\/polygamie-Maroc-autorisation-juge-1024x683.webp 1024w, https:\/\/avocatmarocain.com\/wp-content\/uploads\/2026\/03\/polygamie-Maroc-autorisation-juge-768x512.webp 768w, https:\/\/avocatmarocain.com\/wp-content\/uploads\/2026\/03\/polygamie-Maroc-autorisation-juge-18x12.webp 18w\" sizes=\"(max-width: 1536px) 100vw, 1536px\" \/><\/p><h2>Eheschlie\u00dfung im Ausland und Anerkennung f\u00fcr im Ausland lebende Marokkaner<\/h2><p>L'<strong>Artikel 14 des Moudawana<\/strong> autorise les <a href=\"https:\/\/avocatmarocain.com\/convention-franco-marocaine-statut-personnel\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3077\">Marocains r\u00e9sidant \u00e0 l\u2019\u00e9tranger \u00e0 contracter mariage<\/a> selon les formalit\u00e9s locales du pays de r\u00e9sidence. Pour que ce mariage soit reconnu au Maroc, les conditions de capacit\u00e9, de consentement et l&rsquo;absence d&#8217;emp\u00eachements l\u00e9gaux doivent \u00eatre respect\u00e9es.<\/p><p>L'<strong>Artikel 15<\/strong> erfordert, dass die Ehegatten innerhalb einer bestimmten Frist eine Kopie der Heiratsurkunde bei den marokkanischen Konsularbeh\u00f6rden einreichen. <strong>drei Monate<\/strong>Ist es unm\u00f6glich, das Dokument rechtzeitig vorzulegen, k\u00f6nnen die Ehegatten vor dem marokkanischen Gericht eine Klage auf Anerkennung der Ehe erheben (Art. 16).<\/p><p>\ud83c\udf0d <strong>SPEZIELL F\u00dcR MRES<\/strong> Im Ausland lebende Marokkaner k\u00f6nnen einen Anwalt per Vollmacht mit der Durchf\u00fchrung bestimmter Beglaubigungsverfahren oder Familienstreitigkeiten beauftragen, ohne dass daf\u00fcr eine physische Reise nach Marokko erforderlich ist.<\/p><h2>Gegenseitige Rechte und Pflichten der Ehegatten gem\u00e4\u00df Artikel 51<\/h2><p>Die Ehe hat unmittelbare rechtliche Folgen, die beide Ehegatten bei der F\u00fchrung der Familie binden.<strong>Artikel 51 des Familiengesetzbuches<\/strong> Liste der gegenseitigen Verpflichtungen auf:<\/p><ul><li>Rechtm\u00e4\u00dfiges Zusammenleben und gegenseitige Treue.<\/li><li>Respekt, Zuneigung und die Wahrung der Interessen der Familie.<\/li><li>Die gemeinsame Verantwortung f\u00fcr die Haushaltsf\u00fchrung und den Schutz der Kinder.<\/li><li>Gegenseitige Beratung bei Entscheidungen im Zusammenhang mit Familie und Familienplanung.<\/li><\/ul><p>Was das Erbrecht betrifft, so<strong>Artikel 49<\/strong> Der Grundsatz der G\u00fctertrennung bleibt bestehen.
