mit seinen Grundprinzipien offenkundig unvereinbar ist (Artikel 4 des \u00dcbereinkommens).<\/li>\n<li><strong>Franz\u00f6sische Ehe<\/strong> Physische Anwesenheit ist eine wesentliche Voraussetzung f\u00fcr die Einreise franz\u00f6sischer Staatsangeh\u00f6riger (Artikel 146-1 des franz\u00f6sischen Zivilgesetzbuches).<\/li>\n<li><strong>Anerkennung der Scheidung<\/strong> Das Exequatur ist f\u00fcr ein Urteil zwingend erforderlich. <a href=\"https:\/\/avocatmarocain.com\/exequatur-divorce-maroc\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"2814\">Ausl\u00e4ndische Scheidungen sind in Marokko vollstreckbar.<\/a> oder in Frankreich (Artikel 13 des \u00dcbereinkommens und 430 der marokkanischen Strafprozessordnung).<\/li>\n<li><strong>Anrufverz\u00f6gerungen<\/strong> Die Frist f\u00fcr die Einlegung eines Rechtsmittels gegen ein Familiengerichtsurteil in Marokko betr\u00e4gt 15 Tage 1536px\" \/><\/p>\n<p>Die Bew\u00e4ltigung grenz\u00fcberschreitender Familiensituationen zwischen Frankreich und Marokko erfordert eine strenge Kontrolle der <strong>anwendbares Recht<\/strong> und Mechanismen von <strong>Anerkennung von Handlungen<\/strong>F\u00fcr Doppelstaatsangeh\u00f6rige ist die Beziehung zwischen dem <strong>Franz\u00f6sisch-Marokkanisches \u00dcbereinkommen \u00fcber den Personenstand<\/strong> Das Gesetz vom 10. August 1981 und die nationale \u00f6ffentliche Ordnung bestimmen die G\u00fcltigkeit ihrer Ehe bzw. die Vollstreckbarkeit ihrer Scheidung. Dieser Artikel erl\u00e4utert die Grundlagen dieser gerichtlichen Zusammenarbeit und schafft so die notwendige Klarheit f\u00fcr alle Beteiligten an Gerichtsverfahren.<\/p>\n<h2>Grunds\u00e4tze des nationalen Rechts und der \u00f6ffentlichen Ordnung Ausnahme<\/h2>\n<p>Artikel 1 des <strong>Franz\u00f6sisch-Marokkanisches \u00dcbereinkommen vom 10. August 1981<\/strong> Es legt fest, dass der Status und die Gesch\u00e4ftsf\u00e4higkeit nat\u00fcrlicher Personen dem Recht des Staates unterliegen, dessen Staatsangeh\u00f6rigkeit sie besitzen. Dieser Rechtsgrundsatz <a href=\"https:\/\/avocatmarocain.com\/mariage-mixte-au-maroc-et-nationalite\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"2824\">nationales Recht<\/a> internationale private bilaterale.<\/p>\n<p>Die Anwendung ausl\u00e4ndischen Rechts unterliegt jedoch einer grundlegenden Beschr\u00e4nkung gem\u00e4\u00df Artikel 4 des genannten \u00dcbereinkommens. Das zust\u00e4ndige Gericht kann eine Rechtsvorschrift au\u00dfer Acht lassen, wenn diese \u201eoffensichtlich mit der \u00f6ffentlichen Ordnung\u201c seines eigenen Staates unvereinbar ist. Artikel 146-1 des franz\u00f6sischen Zivilgesetzbuches schreibt die Anwesenheit des franz\u00f6sischen Ehepartners bei der Zeremonie vor. Die Kriterienhierarchie ist wie folgt:<\/p>\n<ol>\n<li>Das Recht der gemeinsamen Staatsangeh\u00f6rigkeit der Ehegatten zum Zeitpunkt der Antragstellung.<\/li>\n<li>Mangels einer gemeinsamen Staatsangeh\u00f6rigkeit gilt das Recht des Staates des gemeinsamen Wohnsitzes oder des letzten gemeinsamen Wohnsitzes.<\/li>\n<\/ol>\n<p>Zust\u00e4ndig ist grunds\u00e4tzlich das Gericht am Wohnort der Ehegatten (Artikel 11 der Konvention).
