unerl\u00e4sslich sind:<\/p>\n<ul>\n<li><strong>Barzahlungslimit:<\/strong> Verpflichtung zur Verwendung eines Verrechnungsschecks oder einer Bank\u00fcberweisung f\u00fcr alle kommerziellen Zahlungen \u00fcber 10.000 Dirham.<\/li>\n<li><strong>Zentralisierung und Digitalisierung:<\/strong> Die Bank Al-Maghrib betreibt eine digitale Plattform, die das elektronische Einfrieren von Geldern und die sofortige \u00dcberpr\u00fcfung der Bereitstellung erm\u00f6glicht.<\/li>\n<li><strong>Rezeptfristen:<\/strong> Der Regressanspruch des Inhabers gegen den Aussteller unterliegt einer Verj\u00e4hrungsfrist von sechs Monaten ab Ablauf der Vorlagefrist.<\/li>\n<li><strong>Sanktionsregime:<\/strong> Das Ausstellen eines Schecks ohne ausreichende Deckung wird mit einer Freiheitsstrafe Marokko: Finanzielle Sicherheit und Reformen der Handelsjustiz<\/h1>\n<p>Die rechtliche Landschaft von <strong>Einchecken in Marokko<\/strong> wird unter dem Druck des Gesetzes Nr. 71.24, das darauf abzielt, das Vertrauen in dieses f\u00fcr die Volkswirtschaft unerl\u00e4ssliche Zahlungsmittel wiederherzustellen, einem tiefgreifenden Wandel unterzogen.<\/p>\n<h2>Definition und G\u00fcltigkeit des Zahlungsinstruments<\/h2>\n<p>Le <strong>\u00fcberpr\u00fcfen <a href=\"https:\/\/avocatmarocain.com\/\" target=\"_blank\" rel=\"noopener\" data-wpil-monitor-id=\"2783\">haben Marokko<\/a><\/strong> ist ein Zahlungsinstrument, das unter Artikel 240 f\u00e4llt. <a href=\"https:\/\/rnesm.justice.gov.ma\/Documentation\/MA\/3_TradeRecord_fr-FR.pdf\" target=\"_blank\" rel=\"noopener\">Handelsgesetzbuch<\/a>F\u00fcr seine Rechtsg\u00fcltigkeit sind bestimmte Pflichtangaben erforderlich. Ein g\u00fcltiger Scheck muss die unbedingte Zahlungsanweisung \u00fcber einen bestimmten Betrag, den Namen der Bank (des Bezogenen), den Zahlungsort, das Datum, den Ausstellungsort und die Unterschrift des Ausstellers enthalten.<\/p>\n<p>Das Fehlen eines dieser <a href=\"https:\/\/avocatmarocain.com\/contrat-de-mariage-au-maroc\/\" target=\"_blank\" rel=\"noopener\" data-wpil-monitor-id=\"2795\">Privatperson erw\u00e4hnt das Dokument<\/a> Seine Einstufung als Scheck ist problematisch, obwohl er auch als einfaches Dokument zum Nachweis einer Schuld zwischen den Parteien eingestuft werden kann. Um die Transparenz zu erh\u00f6hen, schreibt Artikel 306 vor, dass jede Zahlung zwischen Kaufleuten \u00fcber einem bestimmten Betrag <strong>10.000 Dirham<\/strong> entweder per Verrechnungsscheck, wodurch der Umlauf von nicht nachverfolgbarem Bargeld eingeschr\u00e4nkt wird.<\/p>\n<h2>Zahlungsst\u00f6rungsmanagement und Bankbenachrichtigung<\/h2>\n<p>Der Zahlungsvorfall tritt ein, wenn der Beg\u00fcnstigte <a href=\"https:\/\/avocatmarocain.com\/nouvelle-loi-sur-le-divorce-au-maroc\/\" target=\"_blank\" rel=\"noopener\" data-wpil-monitor-id=\"2796\">pr\u00e4sentiert ein <strong>Einchecken in Marokko<\/strong><\/a> und dass die <strong>vorherige Regelung<\/strong>Die verf\u00fcgbaren liquiden Mittel reichen nicht aus. Artikel 313 sieht vor, dass das Kreditinstitut im Falle unzureichender Deckung verpflichtet ist, eine Nichtzahlungsbescheinigung auszustellen und dem Aussteller eine f\u00f6rmliche Mitteilung zuzusenden.<\/p>\n<p>Der Prozess wird durch die Erstellung eines automatisiert. <strong>Zentrale Meldestelle f\u00fcr Zahlungsvorf\u00e4lle<\/strong> Die Plattform wird von der Bank Al-Maghrib betrieben und erm\u00f6glicht es Banken nun, Zahlungsausf\u00e4lle in Echtzeit zu melden. Dies f\u00fchrt zu einem sofortigen Bankverbot f\u00fcr den Aussteller, dem es f\u00fcr f\u00fcnf Jahre untersagt ist, Schecks auszustellen, sofern der Sachverhalt nicht behoben wird.<\/p>\n<p><strong>Tabelle 1: Verj\u00e4hrungsfristen und Rechtsbehelfsrecht (Artikel 295)<\/strong><\/p>\n<p>Das Kabinett betont die Wichtigkeit der Einhaltung von Fristen. <a href=\"https:\/\/avocatmarocain.com\/avocat-en-droit-administratif-marrakech\/\" target=\"_blank\" rel=\"noopener\" data-wpil-monitor-id=\"2785\">Rechtsanspr\u00fcche zur Wahrung von Rechten<\/a> Gl\u00e4ubiger.
