Diese Anforderung begr\u00fcndet das Mietverh\u00e4ltnis und dient im Streitfall als wichtigster Beweis. Bei \u00dcbergabe der R\u00e4umlichkeiten ist au\u00dferdem ein Zustandsbericht vorzulegen.<\/li><li><strong>Recht auf Verl\u00e4ngerung nach zwei Jahren (Artikel 4)<\/strong> : Der <a href=\"https:\/\/avocatmarocain.com\/loi-67-12\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"2721\">Der Mieter erwirbt das Recht<\/a> Bei Verl\u00e4ngerung des Mietvertrags, nachdem der Mieter die R\u00e4umlichkeiten mindestens zwei Jahre lang ununterbrochen genutzt hat. Diese Mindestnutzungsdauer entf\u00e4llt, wenn der Mieter eine Kaution f\u00fcr das Mietrecht entrichtet hat (allgemein bekannt als \u201eSchl\u00fcsselgeld\u201c).<\/li><li><strong>R\u00e4umungsentsch\u00e4digung als Grundsatz (Artikel 7)<\/strong> Lehnt der Vermieter die Verl\u00e4ngerung des Mietvertrags ab, hat der Mieter in der Regel Anspruch auf eine Entsch\u00e4digung wegen R\u00e4umung. Diese Entsch\u00e4digung soll den entstandenen Schaden, insbesondere den Gesch\u00e4ftsverlust, ausgleichen und berechnet sich nach folgenden Kriterien: <a href=\"https:\/\/avocatmarocain.com\/fiscal-maroc\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"2719\">Steuererkl\u00e4rungen<\/a> der letzten vier \u00dcbungen.<\/li><li><strong>R\u00e4umung ohne Entsch\u00e4digung: Strenge Ausnahmen (Artikel 8)<\/strong> Der Vermieter kann in bestimmten gesetzlich festgelegten F\u00e4llen von der Zahlung einer Entsch\u00e4digung befreit sein. Zu diesen F\u00e4llen z\u00e4hlen unter anderem die Nichtzahlung der Miete (f\u00fcr drei Monate), ungenehmigte bauliche Ver\u00e4nderungen am Mietobjekt sowie der Verlust von Kundenstamm und Gesch\u00e4ftswert.<\/li><li><strong>Das formelle Entlassungsverfahren (Artikel 26)<\/strong> Um einen Mietvertrag zu beenden, muss der Vermieter dem Mieter eine K\u00fcndigung zukommen lassen, in der der K\u00fcndigungsgrund angegeben sein muss. Dieser Artikel erl\u00e4utert die Bestimmungen des Dekrets. <strong> Gesetz <\/strong> <a href=\"https:\/\/avocatmarocain.com\/location-au-maroc\/\">49-16 Gewerbemietvertrag<\/a> um Ihnen einen praktischen und pr\u00e4zisen Leitfaden zu bieten.<\/p><h2>Anwendungsbereich des Gesetzes 49-16: Wer ist betroffen?<\/h2><p>Bevor die Rechte und Pflichten analysiert werden, ist es unerl\u00e4sslich, den Anwendungsbereich dieses Gesetzes zu definieren. Dieses oft \u00fcbersehene Dokument sch\u00fctzt sowohl Vermieter als auch Mieter. Diese Entsch\u00e4digung ist nicht symbolisch; sie muss Folgendes umfassen:<\/p><ul><li>Der Marktwert von <strong>Betriebsverm\u00f6gen<\/strong>ermittelt auf Grundlage der Steuererkl\u00e4rungen der letzten vier Jahre.<\/li><li>Umzugskosten.<\/li><li>Die Kosten und Ausgaben, die f\u00fcr Renovierung und Restaurierung anfallen.<\/li><li>Die verlorenen Gesch\u00e4ftsverm\u00f6genswerte.<\/li><\/ul><p>Jede Klausel im Vertrag, die darauf abzielt, dem Mieter sein Recht auf Entsch\u00e4digung zu entziehen, ist nichtig. Dies ist eine Frage des \u00f6ffentlichen Interesses und bildet den Grundpfeiler des Rechts. <strong>Schutz des Mieters<\/strong>.<\/p><h2>F\u00e4lle von R\u00e4umung ohne Entsch\u00e4digung: Ausnahmen f\u00fcr den Vermieter<\/h2><p>Das Recht auf Entsch\u00e4digung ist nicht absolut. Artikel 8 des <strong>Gesetz 49-16 Gewerbemietvertrag<\/strong> erstellt eine umfassende Liste von Situationen, in denen der Vermieter mit der <strong>K\u00fcndigung des Gewerbemietvertrags<\/strong> ohne Zahlung einer Entsch\u00e4digung.
