Die Grundgesetze<\/h3><p>Das Mietrecht wird von zwei grundlegenden Rechtstexten geregelt:<\/p><ol><li><strong>Gesetz Nr. 67-12:<\/strong> Dies betrifft R\u00e4umlichkeiten, die zu Wohn- oder Gesch\u00e4ftszwecken genutzt werden. Es bildet die rechtliche Grundlage f\u00fcr das Verh\u00e4ltnis zwischen Vermietern und Mietern und regelt Miete, Nebenkosten und Reparaturen.<\/li><li><strong>Gesetz Nr. 49-16:<\/strong> Gilt f\u00fcr gewerbliche, industrielle oder handwerkliche Mietvertr\u00e4ge.<\/li><\/ol><p>Der Rahmen <a href=\"https:\/\/avocatmarocain.com\/avocat-safi\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"2021\">Der Rechtsweg ist abgeschlossen<\/a> durch Dahirs, Durchf\u00fchrungsverordnungen und die marokkanische Rechtsprechung, die Licht in die Grauzonen des Mietrechts bringt.<\/p><h3>1.2. Die Notwendigkeit eines schriftlichen Vertrags und des Zustandsberichts<\/h3><p>Die moderne Gesetzgebung hat m\u00fcndlichen Vereinbarungen ein Ende gesetzt und schreibt zur Rechtssicherheit der Parteien eine schriftliche Formalisierung vor.<\/p><h4>Die Anforderung eines schriftlichen Dokuments mit einem bestimmten Datum<\/h4><p>L\u2019<strong>Artikel 3 des Gesetzes Nr. 67-12<\/strong> verlangt, dass alle Mietvertr\u00e4ge von einem Anwalt aufgesetzt werden. <strong>\"An einem bestimmten Datum geschrieben\"<\/strong>Eine m\u00fcndliche Vereinbarung hat vor Gericht keine Beweiskraft, was es im Streitfall schwierig macht, die Bedingungen nachzuweisen.<\/p><p>Ein rechtskonformer Vertrag muss Folgendes enthalten:<\/p><ul><li><strong>Die vollst\u00e4ndige Identifizierung der Teile<\/strong> Namen, Nachnamen, CINE-Nummern, Berufe und Adressen des Vermieters und des Mieters.<\/li><li><strong>Eine genaue Beschreibung des Mietobjekts<\/strong> Genaue Adresse, Aufteilung (Anzahl der Zimmer), Nebengeb\u00e4ude (Keller, Garage) und verf\u00fcgbare private Ausstattung.<\/li><li><strong>Das Ziel des Anwesens<\/strong> : Nutzungsart (Wohn-, Berufs- oder Gewerbenutzung).<\/li><li><strong>Die finanziellen Bedingungen<\/strong> Mieth\u00f6he und -frequenz, H\u00f6he der Mietgeb\u00fchren und Zahlungsbedingungen.<\/li><li><strong>Die Laufzeit des Vertrags<\/strong> und die K\u00fcndigungsbedingungen.<\/li><\/ul><h4>Die Sicherheitsleistung (Vorsicht)<\/h4><p>Die Kaution dient zur Deckung etwaiger unbezahlter Betr\u00e4ge oder Sch\u00e4den.<\/p><ul><li><strong>Gesetzlicher Betrag:<\/strong> Artikel 20 des Gesetzes 67-12 legt fest, dass die H\u00f6he der Einzahlung <strong>darf zwei Monatsmieten nicht \u00fcberschreiten.<\/strong>.<\/li><li><strong>Wiedergutmachung:<\/strong> Es muss in einem <strong>maximale Laufzeit von einem Monat<\/strong> nach der \u00dcbergabe der R\u00e4umlichkeiten.<\/li><li><strong>Garantie:<\/strong> Die beste Garantie f\u00fcr den Mieter bietet das \u00dcbergabeprotokoll im Vergleich zum Einzugsprotokoll. Pflichten des Vermieters (Eigent\u00fcmers)<\/h3><p>Der Eigent\u00fcmer muss sich seiner rechtlichen Verantwortung bewusst sein.<\/p><table><tbody><tr><td><p><strong>Verpflichtungen<\/strong><\/p><\/td><td><p><strong>Rechte<\/strong><\/p><\/td><\/tr><tr><td><p><strong>Lieferung und Wartung (Artikel 5 und 10)<\/strong> Der Vermieter muss f\u00fcr eine angemessene Unterkunft sorgen und alle notwendigen gr\u00f6\u00dferen Reparaturen (strukturelle Reparaturen, Dachreparaturen, Feuchtigkeitsreparaturen) durchf\u00fchren, um den guten Zustand der Unterkunft zu erhalten.<\/p><\/td><td><p><strong>Besuchs- und Inspektionsrecht<\/strong> Der Eigent\u00fcmer hat das Recht, das Grundst\u00fcck zu besichtigen, um sich von dessen Zustand zu \u00fcberzeugen, muss jedoch die ungest\u00f6rte Nutzung respektieren und in der Regel eine angemessene Vorank\u00fcndigung geben.<\/p><\/td><\/tr><tr><td><p><strong>Garantie des ungest\u00f6rten Genusses (Artikel 9)<\/strong> Um den Mieter vor St\u00f6rungen zu sch\u00fctzen, die durch sein Handeln oder das Handeln Dritter entstehen.<\/p><\/td><td><p><strong>Mietpreispr\u00fcfung<\/strong> Die Miete kann unter bestimmten Bedingungen angepasst werden.<\/p><\/td><\/tr><tr><td><p><strong>Einhaltung der gesetzlichen Standards<\/strong>.<\/p><\/td><td><p><strong>Rechtliche Garantien<\/strong> Kann gesetzliche Garantien (z. B. Sicherheitsleistung) geltend machen.<\/p><\/td><\/tr><\/tbody><\/table><p><strong>Ma\u00dfnahmen bei Zahlungsverzug des Vermieters:<\/strong> Weigert sich der Vermieter, gr\u00f6\u00dfere Reparaturen (z. B. Wasserrohrbruch, schwerwiegender Elektroschaden) durchzuf\u00fchren, muss der Mieter eine formelle Mitteilung senden. Kommt der Vermieter dieser Aufforderung nicht nach, kann der Mieter beim zust\u00e4ndigen Richter einen Antrag auf beschleunigte Anh\u00f6rung stellen, um die Arbeiten selbst durchf\u00fchren und die Kosten nach Vorlage der Rechnungen von zuk\u00fcnftigen Mietzahlungen abziehen zu d\u00fcrfen.<\/p><h3>2.2. Pflichten des Mieters<\/h3><p>Der Mieter spielt eine entscheidende Rolle bei der Instandhaltung des Objekts und der Einhaltung der Vertragsbedingungen.<\/p><ul><li><strong>Zahlung von Miete und Geb\u00fchren (Artikel 12)<\/strong> Hauptverpflichtung. Der Mieter ist verpflichtet, die Wohngeldzahlungen und sonstige Geb\u00fchren zu den vereinbarten F\u00e4lligkeitsterminen zu entrichten.<\/li><li><strong>Gebrauch und Wartung (Artikel 14 und 19)<\/strong> Der Mieter muss das Objekt \u201eangemessen\u201c nutzen. Er ist f\u00fcr die regelm\u00e4\u00dfige Instandhaltung und kleinere Reparaturen (Dichtungen, Schalter, kleinere Ausbesserungen) verantwortlich.<\/li><li><strong>Untervermietung und Abtretung (Artikel 39)<\/strong> F\u00fcr eine Wohnimmobilie, <strong>Die Untervermietung oder Abtretung des Mietvertrags ist ohne die ausdr\u00fcckliche schriftliche Zustimmung des Vermieters untersagt.<\/strong>Unerlaubte Untervermietung (auch \u00fcber Online-Plattformen) stellt einen schwerwiegenden Versto\u00df dar, der die K\u00fcndigung und R\u00e4umung des Hauptmieters rechtfertigt.<\/li><\/ul><h3>2.3. Miet\u00fcberpr\u00fcfung<\/h3><p>Das Gesetz regelt die Revision streng, um willk\u00fcrliche Erh\u00f6hungen zu verhindern.<\/p><ul><li><strong>Frequenz:<\/strong> Die \u00dcberarbeitung kann erst nach <strong>drei Jahre<\/strong> ab dem Datum des Vertrags oder der letzten \u00dcberarbeitung (<strong>Artikel 32<\/strong>).<\/li><li><strong>Decken (Artikel 34):<\/strong> Die Erh\u00f6hung ist auf maximal begrenzt. <strong>8 % f\u00fcr Wohnimmobilien<\/strong> und <strong>10 % f\u00fcr Gesch\u00e4ftsr\u00e4ume<\/strong>.<\/li><li><strong>Ausnahme (Artikel 35):<\/strong> Bei Mieten unter 400 Dirham pro Monat kann der Richter von der H\u00f6chstgrenze abweichen, jedoch ohne eine Erh\u00f6hung von mehr als 50 % zuzulassen.<\/li><li><strong>Verfahren :<\/strong> Die Mietanpassung erfolgt nicht automatisch. Der Vermieter muss den Mieter \u00fcber seine Absicht informieren. Weigert sich der Mieter, muss der Vermieter rechtliche Schritte einleiten, um die neue Miete von einem Richter festsetzen zu lassen.<\/li><\/ul><h2>Teil 3: Der gewerbliche, industrielle oder handwerkliche Mietvertrag (Gesetz Nr. 49-16)<\/h2><p>Dieses Gesetz zielt in erster Linie darauf ab, <strong>Schutz der Unternehmenswerte<\/strong> des Mieters, betrachtet als wirtschaftlicher Wert.<\/p><h3>3.1.
