au Maroc est un acte adoulaire \u00e9tabli par deux adouls, apr\u00e8s autorisation du juge de la famille, qui formalise le mariage et ses effets juridiques selon la Moudawana.\u200b<\/li><li><strong>Capacit\u00e9 matrimoniale :<\/strong> L\u2019\u00e2ge l\u00e9gal du mariage est 18 ans (avec possibilit\u00e9 de d\u00e9rogation exceptionnelle par autorisation judiciaire motiv\u00e9e pour les mineurs).\u200b<\/li><li><strong>Consentement &amp; Wilaya :<\/strong> Le mariage repose sur l\u2019offre et l\u2019acceptation (Ijab et Qaboul) ; la wilaya est un droit de la femme majeure, exerc\u00e9 par elle-m\u00eame ou d\u00e9l\u00e9gu\u00e9 selon son choix.\u200b<\/li><li><strong>Sadaq (dot) :<\/strong> Le Sadaq est un bien donn\u00e9 par l\u2019\u00e9poux \u00e0 l\u2019\u00e9pouse ; il a une valeur symbolique et reste la propri\u00e9t\u00e9 exclusive de l\u2019\u00e9pouse (paiement imm\u00e9diat ou \u00e0 terme, total ou partiel).\u200b<\/li><li><strong>R\u00e9gime des biens (article 49) :<\/strong> Le principe est la s\u00e9paration des patrimoines ; les \u00e9poux peuvent conclure un accord \u00e9crit distinct pour organiser la gestion et la r\u00e9partition des biens acquis pendant le mariage, et les adouls doivent informer les parties de cette possibilit\u00e9.\u200b<\/li><li><strong>Dossier de mariage (article 65) :<\/strong> La constitution du dossier suit une proc\u00e9dure encadr\u00e9e et requiert des pi\u00e8ces justificatives (naissance, situation familiale, certificat m\u00e9dical, identit\u00e9, autorisations selon les cas).\u200b<\/li><li><strong>Mentions obligatoires de l\u2019acte (article 67) :<\/strong> L\u2019acte doit inclure l\u2019identit\u00e9 des parties, les r\u00e9f\u00e9rences de l\u2019autorisation judiciaire, le Sadaq, le consentement, les clauses sp\u00e9cifiques, et les signatures\/scell\u00e9s requis.\u200b<\/li><li><strong>MRE :<\/strong> Les Marocains R\u00e9sidant \u00e0 l\u2019\u00c9tranger peuvent se marier selon les formalit\u00e9s du pays de r\u00e9sidence sous r\u00e9serve du respect des piliers, puis d\u00e9poser une copie aupr\u00e8s des services consulaires dans un d\u00e9lai de 3 mois afin d\u2019assurer la reconnaissance des droits civils et de la filiation au Maroc.<\/li><\/ul><p><strong>R\u00e9f\u00e9rences Ce n&rsquo;est pas seulement l&rsquo;union de deux destins, mais la cr\u00e9ation d&rsquo;une cellule stable plac\u00e9e sous la direction conjointe des deux \u00e9poux, fond\u00e9e sur la fid\u00e9lit\u00e9, la puret\u00e9 et l&rsquo;affection.<\/p><p>Depuis la r\u00e9forme historique de 2004, impuls\u00e9e par <strong>Sa Majest\u00e9 le Roi Mohammed VI<\/strong>, le <a href=\"https:\/\/avocatmarocain.com\/le-mariage-en-droit-marocain\/\" target=\"_blank\" rel=\"noopener\"  data-wpil-monitor-id=\"3087\">droit de la famille marocain<\/a> a op\u00e9r\u00e9 une v\u00e9ritable r\u00e9volution l\u00e9gislative. Le Code actuel consacre l\u2019\u00e9galit\u00e9 entre l\u2019homme et la femme, prot\u00e8ge les droits de l\u2019enfant et place la responsabilit\u00e9 du foyer entre les mains des deux conjoints. Pour les futurs \u00e9poux, comprendre les m\u00e9andres de l\u2019<strong>acte de mariage adoulaire<\/strong> est crucial pour garantir la s\u00e9curit\u00e9 juridique de leur famille, particuli\u00e8rement dans un contexte de mobilit\u00e9 internationale croissante.<\/p><h2>I. Les conditions de fond : Les piliers du pacte matrimonial<\/h2><p>Le contrat de mariage au Maroc n&rsquo;est pas un simple formulaire administratif ; il exige la r\u00e9union de conditions de fond strictes dict\u00e9es par la loi.<\/p><h3>1. Le consentement (Ijab et Quaboul)<\/h3><p>L\u2019essence du mariage r\u00e9side dans l\u2019accord des volont\u00e9s. Selon l&rsquo;article 10, le mariage est conclu par le consentement mutuel des deux contractants, exprim\u00e9 en termes consacr\u00e9s ou par tout signe compr\u00e9hensible pour ceux qui ne peuvent s&rsquo;exprimer oralement. Ce consentement doit \u00eatre concordant, d\u00e9cisif et non soumis \u00e0 une condition suspensive.<\/p><h3>2. La capacit\u00e9 matrimoniale et le mariage des mineurs<\/h3><p>La r\u00e8gle g\u00e9n\u00e9rale est que la capacit\u00e9 s&rsquo;acquiert \u00e0 <strong>18 ans r\u00e9volus<\/strong>. Toutefois, le juge de la famille peut autoriser le mariage d&rsquo;un mineur par une d\u00e9cision motiv\u00e9e si l&rsquo;int\u00e9r\u00eat de celui-ci est d\u00e9montr\u00e9. Cette proc\u00e9dure n\u00e9cessite une expertise m\u00e9dicale ou une enqu\u00eate sociale, et la d\u00e9cision du juge est sans appel.<\/p><h3>3. La tutelle matrimoniale (Wilaya) : Un droit de la femme<\/h3><p>L&rsquo;une des avanc\u00e9es majeures de la Moudawana est de faire de la <strong>tutelle matrimoniale<\/strong> un droit appartenant \u00e0 la femme majeure. Le Sadaq (La Dot) : Symbole et Protection<\/h2><p>Le <strong>Sadaq<\/strong> consiste en tout bien donn\u00e9 par l&rsquo;\u00e9poux \u00e0 son \u00e9pouse. La l\u00e9gislation marocaine pr\u00e9cise que son fondement l\u00e9gal repose sur sa <strong>valeur morale et symbolique<\/strong> plut\u00f4t que mat\u00e9rielle, afin d&rsquo;encourager la cr\u00e9ation de foyers sans pressions financi\u00e8res excessives.<\/p><ul><li><strong>Propri\u00e9t\u00e9 exclusive :<\/strong> L&rsquo;\u00e9pouse a la libre disposition de son Sadaq et l&rsquo;\u00e9poux ne peut exiger aucun apport en ameublement en contrepartie.<\/li><li><strong>Paiement :<\/strong> Il peut \u00eatre pay\u00e9 d&rsquo;avance ou \u00e0 terme, en tout ou en partie.<\/li><li><strong>Fixation :<\/strong> Il doit \u00eatre fix\u00e9 lors de l&rsquo;acte. \u00c0 d\u00e9faut, le tribunal peut le fixer en tenant compte du milieu social des \u00e9poux.<\/li><\/ul><h2>III. La constitution du dossier de mariage : Proc\u00e9dures et pi\u00e8ces \u00e0 fournir<\/h2><p>L\u2019\u00e9tablissement de l\u2019acte de mariage est une proc\u00e9dure rigoureuse encadr\u00e9e par l&rsquo;article 65 du Code.
